Hi i am looking at taking a bank to court and am checking if there are any documents on here that may help me. Ideally a PAS 17271 or code of practice taht i may have a look through.

Am happy to keep the board up to date with how i am getting on in return.

Any comments made for your own thought provocation only or based on previous experiences. These may not work out for you as they have for me so always check with appropriate professionals.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

The industry code of practice - which costs £102 to buy - was introduced in 2017 and lays out how payment providers should protect customers from fraud and financial abuse.

That’s the one, was hoping someone knew of a PDF online somewhere save risking the £102.

fraudster has accessed my accounts and I don’t think that the banks followed process and did all they could. Potential brief of GDPR etc. am wanting to hold them to task on it.

Also one of the banks was advised of the frauds but did not act which made matters worse.

what you are referring to is British Standards Institution's (BSI) code of practice PAS 17271:2017

BSI, the business standards company, has launched a new code of practice that gives recommendations to organizations for protecting vulnerable...

What you are asking refers to protecting vulnerable customers.

Please give a the full version of events of what has happened form start till now for you to come on here and ask this question as it will be more beneficial so you get the correct advice you require.

Have you sent the Bank a Subject Access Request (SAR) asking for 'ALL DATA' that simple phrase covers whatever format they hold that data in whether it be recorded phone calls, emails, writing etc.

I think it's pretty shocking that there's a set of standards banks are supposed to follow, “BSI: PAS 17271: 2017 Protecting customers from financial harm as result of fraud or financial abuse”, but they effectively prevent the victims of fraud knowing what those standards are unless they pay £102 for the privilege. But I've done some online searching and come to the same conclusion as you. It isn't available online anywhere as a free pdf. If you want it you have to pay.

AFAIK we don't have a copy here on CAG but even if we did it's Copyright British Standards Institute and I'm sure we'd have them on our backs very quickly if we made it available on here for free.

There's an article here about it - it cites the specific section at the end of the article that may be relevant

Little known document that could help fraud victims get money back from their bank - Mirror Online

And I came across an FOS case that mentioned it

Customer was told she needed to pay a tax bill – or face arrest (financial-ombudsman.org.uk)
