Just a quick update - today I received a letter direct from MBNA, I assume as a result of my CCA request to Arrow? -

 

Dear Mr....

A/C No xxxx

Enclosed you'll find your current MBNA Credit Card terms and conditions -

current terms! those that are available on their website..

they'll prob have to better than that to satisfy a cca request ie at least an accurate recon of the original terms some time ago?

anyway, as said, it seems stayed

Also, it's now over 33 days since my defence was filed (nothing showing since then on MCOL), do I just wait to see if they have taken further action
maybe not just yet stayed. its 33 deemed days from when they actually sent it to the claimant. (you filed online on the 5th sept? allow for any court backlog)

if you want to double check, give the court a ring.

that's a set of t&C's from 2006

not 1996

 

says 2006 and says £12 fees

fees in 1996 were £35+

 

and ofcourse no signed agreement.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Just wanting to check - I've heard nothing from anyone (Arrow, Shoosmiths or Court) since October.

Do I just try and forget about it?

In your experience, is it likely to raise its head again?

Will they be searching for more documentation?

 

I know I shouldn't worry but I do!

Now that ARROW have won the other similar claim to this one,

which I defended at the same time in Summer of 2016, I'm wondering if they are now likely to unstay this one and bring it to court in the same manner?

 

I have not received any hearing date for this claim as yet, but I've just checked the MCOL website and it has been updated to 'Your claim was transferred to MIDDLESBROUGH on 19/02/2019'

 

I'm now wondering if I might be better to contact ARROW before this happens to make an offer of settlement before I have to pay further costs if I were to lose again?

 

I know Andyorch is aware of this second claim, just bringing to the fore for any updates.

So it is on the move ...but as to what you wont know until the court informs you what application has been made.

You could ring MIDDLESBROUGH and ask for any paperwork in connection...get a head of their move
