DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

hi Andy, thanks for the advice.

 

Is there a template letter for inviting them to discontinue their claims for my wife and mine credit cards, and could you please direct me to the info on making a application to strike it out with costs.

I have identical letters for both my wife and mine Lloyds credit cards both stating they cannot find the information I requested I presume they mean the CCA letter I sent them. My wife looked at her credit report and it said that the Lloyds debt was "terminated" what ever that means. presumably Lloyds have written it off and sold it to Cabot?

As far as I know there is no court proceedings in progress, the letter I got today said that they are not permitted to go to court as the "debt is currently unenforceable"

 

Just an aside is Kathy Cakebread a real person?

right so nothing more to do then on either card debt

ignore them now

 

 

until/unless they find enforceable agreements

or

you get a claimform from THE COURT for either.

My mistake I though you was subject to litigation...ignore that post ...but most important.. ignore them.

What they are claiming is that although the debt is entirely unenforceable and they will get done if they continue to try and collect the money they "know" that you owe it so you should be a good little boy and pay them something for their troubles.

As there is no legal or any other obligation to do so why would you consider setting up a payment plan? They admmit that they have no paperwork whatsoever to show that any amount was ever due but they expect you to believe that you should cough up anyway because they want you to.

I had one like this with Cabot a few years ago..

..they admitted they didn't have the paperwork,

eventually it just disappeared off my credit report never to be seen or heard of again.

 

Another one I had with them and they kept sending letters like you have received

saying they are still trying to find the paperwork from the original lender,

 

 

this went on for months and every so often I would get a letter saying they haven't got it yet..

.I ignored every letter..

..eventually earlier this year they said they were closing their file as they could not get the proper paperwork,

 

 

I would just sit tight, ignore them and hopefully you will get a similar outcome
