  2. Hi everyone, Recently I did a financial statement for the CAB and it turns out that I have been overpaying my rent by £48 per month for at least 5 years. I am on Housing benefit and have been paying £100 per month to cover the short fall in the benefit payment. I contacted my letting agent querying this and was told that my account is showing that I am just current in the amount I owe, not showing a credit balance as my calculations seem to show. My rent is £700 per calendar month or £8400 per year Housing benefit £594.08 x13 - 4 weekly payment £7723.04 per year My top up £100 x12 calendar month £1200 per year £523.04 over payment per year I think the maths is correct and I think this situation arose because a one point we were in rent arrears of about £1000 and agreed to clear the arrears by paying £100 a month rather than the £52 needed to cover the HB shortfall. We have continued to pay the £100 per month since that date. My question is how do I go about getting a break down of all payments to my agent and what to do if they refuse to cooperate.   4. This is a credit card debt from Lloyd's bank from 2005, I was paying £5 per month until 2013 Thank you dx100uk, is it worth me sending a letter stating that I wish to revoke their right to come to my home ?
  5. Hi folks, For the last few months Cabot has been sending me letters demanding that I contact them. As the failed to provide me with the CCA in 2016, I ignored them. Today I received a letter stating that they are instructing Moorcroft to arrange a visit to my home. I sent them the template CCA letter on 28th July 2016, and received a reply on 3rd August 2016 stating that they were unable to get the relevant documents, and acknowledging the 12 day limit. (I still have all the letters). Up until recently I have not had any communication with Cabot for the past 2 years. My question is there a template letter I can send and where do I stand?
  6. Thank you this is the best advice I've received. I finally got through to OFgem who passed me on to CAB who basically said do nothing and hope the new supplier will be sympathetic.

  8. Hi Guys, I'm was a customer of GB energy, and after finding out they're I bust followed the advice to take a meter readings. However when I went to get the electric readings I found that my meter doesn't display the numbers and is faulty. GB energy will not respond and Ofgem keeps cutting me off when I try to phone them. Any advice please?

Hi dx100uk, Thanks for taking the time to answer I have identical letters for both my wife and mine Lloyds credit cards both stating they cannot find the information I requested I presume they mean the CCA letter I sent them. My wife looked at her credit report and it said that the Lloyds debt was "terminated" what ever that means. presumably Lloyds have written it off and sold it to Cabot? Hi Ford, As far as I know there is no court proceedings in progress, the letter I got today said that they are not permitted to go to court as the "debt is currently unenforceable" Just an aside is Kathy Cakebread a real person?
  12. hi Andy, thanks for the advice. Is there a template letter for inviting them to discontinue their claims for my wife and mine credit cards, and could you please direct me to the info on making a application to strike it out with costs.

I would be grateful for some further advice, I finally received a letter from Cabot Finance, saying that they cannot provide me with the requested information within the relevant time period, and they are continuing to request the information from Lloyds and the account will remain hold with the customer care dept until such time as they can comply with my request. They then state the credit agreement is unenforceable and they are not permitted to obtain a judgement or decree against me, however they then state I am obliged to repay the outstanding balance as confirmed in the letter going on to recommend that I contact them to set up a repayment plan. Where do I stand at the moment?

I honestly don't know, the assumptions and errors made by the assessor, were glaring and if she had bothered to read the form and supporting evidence, 30 plus pages including x rays, consultants reports and letters, all indexed to the questions, relevant information and statements clearly highlighted, to make it impossible for the DWP and its accomplices to say they didn't have the necessary information. she would have probably not written what she did. However, I do think that a covert recording allows people to hoist ATOS by its own petard and gives you a clear picture of the process to go forward with a mandatory reconsideration or tribunal. I think that when they know that they will be held accountable on a official recording they don't use the standard interview techniques, but stick to the letter of the law. My personal opinion is that ATOS and its assessors hold everyone they see in contempt, regarding them as feckless parasites trying to work the system. I would despite the risks use covert recording again because the DWP and ATOS cannot be trusted

Hi Jason, I suppose you could have called it covert, my wife's phone was in a fabric phone case in the outside mesh pocket of the folder I use to keep all the forms etc together, it was placed on the desk in clear view, but the screen was facing down so not visible. I didn't tell the assessor that the phone was recording. But with out having a recording I couldn't prove the "errors" that turned up in the report.
  17. Hi Folks I have just had my reconsideration letter through the post and fortunately was successful. I think that this was due to my secretly recording the whole process via a mobile phone. The recording allowed me to quote exactly what I said and point out the "inconsistency's in the ATOS assessor report. Without this recording I would have been at a loss to recall a fraction of what I said, and what the assessor said and given the numerous distortions and assumptions made by the assessor it was a godsend. I don't know what other people think, but I would advise anyone undergoing the PIP/ESA process to try and get a recording of any and all communication with the DWP or their contractors.
  18. Just to let you know I was successful with my reconsideration, and am getting the enhanced rate of mobility. I know that having a recording of the whole "assessment" was invaluable when going through the ATOS report and being able to point out the "inconsistency's " when what I said didn't match what was written down.
  19. Thanks for the heads up. I think I may have covered this in my letter requesting a CCA, in which I clearly stated that all communication between us must be in writing and a notice that I routinely record all telephone calls. I hope this will suffice as they were calling 3-4 times a day at all hours.

Thank you very much Stigman, I've been stressing out about this for days, and talking to my wife just now it seems that both cards were done via a telephone call from Lloyd's trying to offer financial advice on what to do with my compensation money, and my wife recalls that she mentioned that we were going to spend some money on a holiday, it was then that she was offered credit cards for both of us, "to give us extra protection whilst aboard". To the best of her recollection neither of us signed a credit agreement , the cards just arrived a few days later. However this was 2004 and memories can be fuzzy. Anyway thank you once again for taking the time to help me. regards Gary

  22. Thank you Stigman, The 2 cards were given to us in 2004/5 after a successful compensation claim settlement, I have not recollection of applying for them, but I may have. regards Gary
  23. Thank you Stigman, I looked up the claim form link, its rather daunting. Sorry to be dense but even if they can't provide a credit agreement, they can still take us to small claims?
