Paying in defaulted accounts past the 6 year date on credit file

Hoping for some advice.

 

After significant debt issues just over 6 years ago

I am now in the year when various defaults and a CCJ hit their 6 year mark on my credit file.

 

All payments being managed through stepchange (I have charge against my house connected to CCJ)

 

If i understand correctly as the respective default dates pass these will drop off my credit file?

Do the accounts completely disappear from the file or just show as accounts that are being paid?

 

Are companies more likely to accept a full and final offer once the 6 years from default date has passed?

(i understand the money is still owed but i'd like to pay them as little as possible!)

 

The CCJ is managed by Marlin, who brought it from Virgin and Optima... they've not been the nicest company to deal with...

 

I have claimed back all PPI etc so i can't reduce the debts any further that way.

 

All help appreciated!

once they fall off [as the defaults reach 6yrs] they cant come back

same with the CCJ

 

 

bar the CCJ/CO [same you didn't defend it!]

 

 

have you sent whom you are blindly paying thru Step Change a CCA request ever

to prove the debt ARE enforceable?

as step change will simply blindly advise you to pay.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I have had cca from my creditors, and I did attend court.

 

 

Optima pushed for my house to be sold to pay the debt

but the judge stipulated that provided I met the monthly payment of the ccj the lien could not be enforced.

 

So if the defaults drop off they become 'invisible'.

 

 

Can companies pursue you at this point for a ccj?

and are confusing that with the defaulted date?

AS you are still paying the debts , yes they could still go for a court claim and I am afraid that while you continue paying this will always be the case.

 

You say that they all complied with CCA requests?

Depending on the dates these accounts were taken out , even a response, while technically complying with S77-79 may not be enough to enforce in court .

 

I sent CCA requests off for pre Apr 2007 accounts and some of the responses showed that the agreements were incorrectly written so could not be enforced in court. I am currently at 4 1/2 years with no payments - mind you I have no assets and just student finance to support myself

Any opinion I give is from personal experience .

If I understand correctly none of my debts (6 defaults and 1 ccj) are statute barred as I have been paying them via stepchange BUT all of the default dates on credit files and ccj date on credit file will hit 6 years this year.

 

I'm hoping as defaults cannot reappear on my credit file that the companies will accept very reduced full and final pay offs? Or can they still go for ccj?
