  1. Thanks for replies. It's not a sham company - they've been around donkeys years (and everything bang up to date on companies house). They accept credit cards at their trade counter but not for goods and services... Which I do find quite odd! Plus I would be happier with the additional benefit of s75 cover... ...downside is the manufacturer of Windows they fit are lovely. Back to the drawing board!
  2. Long story short - my brother has offered to pay for new Windows at front of my house (old single glazed ones at end of their life). Found good local company but don't accept credit card payments (they also don't offer finance! Yay!) They accept bacs - can you get a bacs payment from a credit card company?? Sorry if this in the wrong section.
  3. Bu*ger. Was hoping that as accounts had defaulted and they hadn't pursued a ccj in that 6yr period they wouldn't get a the option of a second bite at the credit file cherry.

If I understand correctly none of my debts (6 defaults and 1 ccj) are statute barred as I have been paying them via stepchange BUT all of the default dates on credit files and ccj date on credit file will hit 6 years this year. I'm hoping as defaults cannot reappear on my credit file that the companies will accept very reduced full and final pay offs? Or can they still go for ccj?
  5. I have had cca from my creditors, and I did attend court. Optima pushed for my house to be sold to pay the debt but the judge stipulated that provided I met the monthly payment of the ccj the lien could not be enforced. So if the defaults drop off they become 'invisible'. Can companies pursue you at this point for a ccj?
  6. Hoping for some advice. After significant debt issues just over 6 years ago I am now in the year when various defaults and a CCJ hit their 6 year mark on my credit file. All payments being managed through stepchange (I have charge against my house connected to CCJ) If i understand correctly as the respective default dates pass these will drop off my credit file? Do the accounts completely disappear from the file or just show as accounts that are being paid? Are companies more likely to accept a full and final offer once the 6 years from default date has passed? (i understand the money is still owed but i'd like to pay them as little as possible!) The CCJ is managed by Marlin, who brought it from Virgin and Optima... they've not been the nicest company to deal with... I have claimed back all PPI etc so i can't reduce the debts any further that way. All help appreciated!
  7. Thank you. I'll speak to Virgin tomorrow to try and find out why this has happened. Am quite shocked they can send documents undated and they can have such ramifications. How can I respond in 14 days to the default notice if there is no date?? I should point out in my town there are two roads with the same name and it's not unusual to have to put a letter meant for the other street back in the post...so dates are important!
  8. If the document is legal without a date then I will wrestle with Virgin, if the document is not legal I will deal with both Virgin and the CRAs. It's whether it should be dated that I am querying.
  9. It's the first one - no notice of default sums letter received. Just checked my Noodle file and no sign of it on there... Loathed to pay £6 for individual reports on a bill that amounts to £20.
  10. Quick background... I left Virgin Media due to cost of their service constantly creeping up. I left at the end of my contract. I was told I would be refunded the month in advance that I pay and I said to take any charges from that. All agreed, I canx my DD... they start pursuing me for £20 in charges, I say this is due to come off my refund, I get contacted by BFO debt collectors, advise them the same... I have now received an UNDATED default notice. I am gutted. Been working really hard to improve credit rating. Is the document legal without a date? Many thanks
  11. Hoping someone can put me right about a few things as I've been trying to do my research and feel a bit confused. My creditors are managed through StepChange. I currently have one CCJ from 2010 that I pay as per court instructions, I have 5 other creditors with all accounts defaulting in 2009 or 2010 except one that Cabot brought and chose not to default until 2012! I have no issue that I owe these debts... all PPI claimed back and applied to accounts where appropriate. I'm trying to get clear what happens after 6 years. The CCJ falls of the register but the judgement still stands until Marlin/Cabot come up with F&F that I can afford... that makes sense. But what about the defaults? I thought they'd drop of my credit file and then I could make cheeky full and finals.. .. would they still be able to go for a ccj either before or after the 6 year mark? Could any agency the debt might be sold to be able to re-register the default? Hx
  12. Hello, Thank you for replying. I guess I'm a bit worried as optima legal were very aggressive in pursuing a ccj and property charge at the same court hearing despite the fact I was paying the debt off via the cccs (stepchange now). Having diligently paid this debt I am concerned they will be as aggressive with any legal options open to them once the ccj expires on the register.
  13. Hello, Hoping for a bit of guidance. I have a ccj which will reach is 6 year mark next year. At the time the ccj was granted the creditor put a charge on my property the judge stated that the creditor could not force me to sell my house providing I kept to the repayment plan StepChange put in place. I have done this. What I would be grateful to know is whether this extends beyond when the ccj is off of my credit record. I have no intention of shopping paying - it's my debt and my responsibility. If I understand correctly no creditor can get another ccj for this particular debt. .. they only get one bite of the apple. What I am worried about is whether they can force me to sell my house to pay off the remaining amount. Does anyone have any experience of this? Thanks in advance
  14. Arghgg. More sodding paperwork!I think part of the problem is the solicitors I am using. Apart from the FOS, whom i am happy to go to, is there anything within the whole PART 36 settlement offers stuff that gives a maximum time the settlement has to be paid in once agreed?
  15. Hi Folks, I agreed back at the start of May to settle my PI claim (marginally below what the solictor suggested I accept as my lowest offer). I received a letter from my solictor saying it usually takes 4-8 weeks for the settlement to be paid (even that seemed like a long time but i rolled with it). It is now well past the 8 weeks. I rang my solicitor and was informed by her secretay that it can take longer than that - and 4-8 weeks was 'average', and that they had not received a payment as yet. I settled because i just wanted the toing and froing over and done with and yet i'm still having to push and chase. Does anyone know if there is any legislation that governs the time limit that settlement sums have to be paid once agreed? Can i claim interest on the sum due to the delay? My solictors are ok...not great, just ok so i'd like to go back to them an demonstrate i seriously want that cheque in my grubby mitt asap! Fed up of doing all the chasing.
  16. Well the other side have upper there original offer by about 60% compared to their first offer but it is still below what my part 36 offer was. But i'm torn. I'm at the point where i really just want this over. I don't want to have to face down managers who i work with on a daily basis now in a court case. But then i do feel like the defendants are taking the michael by making such a low offer. My solicitor is happy to pursue the case further but realistically the offer made by the other side is about 12% below the lowest offer she recommended i accept so it is not a huge difference we are talking about. The other side have categorically said that this offer is their final offer and i think the next step is disclosure of documents... Any thoughts/advice peeps?

  19. Well looks like i'm heading back to my original question... POC filed, and defendants replies recieved. In all honesty outright lies in places and certainly 'grey' areas in their response/s but still left me really upset as they are saying it's my fault. My solictor put forward part 36 offer which was rejected but counter offer (with no admission of liability) for less than half the amount put forward by defendants. This amount didn't even cover my lost wages. I rejected this offer. So now I have provided all documents etc for disclosure, and provided dates that I am not available for court. I know that a settlement may still occur BUT having seen how the defendants have replied it feels like they are mud slinging my way to try and make it all my fault. I am not entirely sure they will back down. If it goes to court it will be my word against 6 'managers' for the other sides - which I hate the thought of. Random questions - how much does a court case like this cost in reality - ignoring any potential award...i'm just talking about solicitors and barristers and judges costs i guess...
  20. I'm not sure I'm posting this in the right forum - but I'm hoping someone might know the answer. A friend has got an interview for a job in civil service and wonders if he has to declare a conviction he got for assault when he was 14 - he's now 38! The pack says he doesn't have to include spent convictions. His sentence was 40 hours juvenile community service. He has never been in any other trouble. All help appreaciated.
  21. Hello, Firstly apologies if this is in the wrong section. I'll try to keep it brief. I have a credit card debt that has been sold to Cabot. I have reclaimed ppi (wasn't much but i reclaimed it anyway). I have been paying this debt through the cccs for over 3 years - the same amount give or take a pound. This debt has never had a default registered against it despite me falling behind when it was with original creditor. I have checked my credit file and over the course of the last 8-9 months my credit files shows my payments are late, indicating I'm now 6 months late in payment. Cccs are definately passing the money on. I have written to Cabot recorded delivery (nearly a month ago) asking them to correct this error but i have had no response. Where can i go from here to address the issue?
  22. Technically they would be witnesses for one of the defendants so would I be right in thinking it would not be my ( my solicitors) responsibility to pin them down? Anything they would need to say is covered in emails I have printed off.
  23. Lol. Probably. Just wondered if anyone had any experience in such circumstances (esp as for next 6 weeks work commitments mean a phone call during the day is out of the question). It's all gone on soooo long that I guess the flickering light at the end of the tunnel is too attractive - and I just want some kind of resolution.
