Hi

 

I recently got into a mess with the council tax & knwo its was stupid but tried to pretend it would just go away.

 

 

I had letters from Phoenix Commercial and contacted them and agreed to a £50 per month payment.

I made two payments although one was a few days late.

 

 

I have now had another letter dropped through my door stating payment is needed in full or the bailiff is coming back with a locksmith.

 

I contacted the office and was told they had received both payment s but I now have to deal with the bailiff himself.

 

 

I messaged him and he stated payment was expected in full,

I explained I could not afford this and had no one I could borrow it from.

 

 

He was quite off hand and told me he wants to talk to me today.

To be honest I am too frightened to speak to him.

 

I am quite happy to continue with the payment plan originally set up.

 

Is there any advice or suggestions please.

 

 

I know I was stupid and should have sorted this out properly before it came to this.

locksmiths and forcing entry on CTAX LO's are a figment of the bailiffs imagination.

 

 

I doubt you've got that in the letter either.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Yes I have had a letter.

 

 

I do not understand why I can not continue with the original payment plan,

I'm not refusing to pay my next payment is the middle of November.

 

 

I just really do not want to talk to the man he is not a pleasant character at all.

I tried contacting Phoenix direct and they just say talk to the bailiff.

and when did they get the LO and for how much.

 

 

I take it the bailiffs claimed the agreement was over because you were late on one payment?

You say that you received two letters from Phoenix. Do I take this to mean that they are enforcing two separate debts?

 

Can you let us know the amount of the Liability Order (or orders).

 

You contacted Phoenix to make a payment proposal and this was accepted. When was the payment agreement set up and how many payments should you have made so far?

Hi Dx. the council was Hertsmere.

 

I missed two direct debits so the debt was for the whole year roughly £1300.

 

Yes because I was late with one payment that's what the bailiff says.

 

I've made two payments to Phoenix so far the next is due middle of

November.

 

The payment agreement was made in Sept,

it was the sept payment that was a few days late.

The first letter you had from them should have been headed Notice of Enforcement - do you still have it? If so can you give us the date it was written, the date you received, how it was sent - 1st Class, 2nd Class or via a third party mailer, the date on which they said you had to respond?

 

Providing the Bailiff has not gained access to your home previously then he can bring as many locksmiths as he wants because they can do nothing. However if you have anything of value outside - a vehicle perhaps - then that would be at risk of seizure.

Well for ctax they cannot do that

Unless they have already have been in your property and list goods etc etc

 

You need to complain and loudly to the council

 

But please make sure you are reading the letter carefully!!

 

And it simply says may this and may that if you don't do xxxx
