Hi all I am needing some help.

 

 

I am looking to claim back all possible charges for payday loans I took out in the past.

 

 

In some instances I had numerous roll-overs, re-lending etc

so I want to raise a dispute with all of the past lenders and try and claim back some or all of the charges.

 

 

So would like some letter templates from those who have had success.

 

By the way all of these have been settled and none are chasing me for anything.

I feel slightly difficult to offer a template letter.

Are you claiming back because you feel affordability was not looked into when you took the loans out.

Without knowing your personal details rather difficult to compose.

Perhaps this will help you compose the correct letters for your circumstances.

Step one – get the facts

The first thing is to assemble a detailed list of the loans you had. Write to the lender and ask for the following information for any loans they made to you:

 

the date taken out, whether you rolled the loan, the date the loan was repaid or how much is still outstanding;

the interest and charges that were added;

whether you missed any payments;

whether the lender performed a credit check before lending the money initially and on any rollover.

Step two – ask lender for a refund

Next you need to write to the lender again, say you want to put in a complaint because the loan you were given was not affordable and ask for a refund of the charges and interest added. Use the affordability checklist above and put in details of your situation. I can’t give a template letter because it is all going to depend on your situation, but letters could include phrases such as:

 

“At the time I took the loan in August 2013, my hours had been cut at work and I was struggling with my normal expenses.”

“My credit record would have showed that I was already in arrears on my loan from xxxx bank.”

“I couldn’t afford to repay this loan, so I had to take out another payday loan with xxxx.”

“After I had rolled the loan twice I was so worried about the interest going up that I repaid it even though this mean not paying my council tax and other bills.”

“I borrowed £250 from you for 30 days. My monthly income was only £980 and my rent and season ticket to work came to £600. I could not have repaid this loan and afforded to eat and pay my other bills.”

“I took out 4 loans from you between 2011 and 2013. I repaid your loans with loans from other payday lenders and repaid their loans by borrowing from you. You should have realised from the pattern of increasing loan amounts that I was not coping with my debt.”

thanks everyone...have drafted my own letter requesting loan charges to be refunded plus 8% as i do not feel sufficient checks were taken when the loans were provided, in one case 10 loans by one pdl in a 12 month period, also requesting for all references from all payday loans to be removed from my credit file....you will find lots of cases on the FOS website where they have ordered the lenders to do this

Halifax 1st offer dated 5/5

Capital One ack Data Protection Act request rec 6/5

Request for repayment to Capital One 2/8

LBA sent 22/8

Court proceedings issued 13/10

Settled in Full 9/11

Donation made 14/11

Hi yes i have, so far FOS have upheld complaints for;

Mr Lender - write off any outstanding balance and remove adverse credit files

Think Money - original loan for £700 - have paid back £601 - just over £400 left - FOS said to pay just the £99 left from original loan and removal of adverse credit files

Safeloans have agreed to remove the CCJ from my credit file

Trusted Quid have agreed to a payment plan to cover just the original loan amount and removal of adverse credit files.

 

Still waiting on FOS for;

Payday Express

247 Money Box

Fancyapayday

 

NovaLoans have been in contact as per request by FOS.

 

TxtLoan/MyJar have refunded £108 and removed adverse credit files.

 

So far total refunds equal just under £1k.
