The police said they could arrest her for theft if she doesn't go in

 

They are misrepresenting their powers.

 

 

Arrest is only available under certain circumstances (s24(5) PACE 1984 http://www.legislation.gov.uk/ukpga/1984/60/section/24) and this situation does not seem to apply.

 

 

However they are entitled to put questions to her about what she did with PH's television, in a voluntary interview.

If they wish to do that, make sure she has the free legal representation.

 

If your partner chooses not to reply to questions, then I think the Police will struggle to make out a case which CPS would prosecute.

 

 

To charge a person, they need reasonable grounds to consider that person has committed an offence.

 

 

The bare fact that she hasn't told PH where their television is would not, I think, be enough.

 

 

She would however still owe PH the due payments.
