What even without providing the original agreement ?

 

Yes 99% of claims issued that we deal with on CAG...the claimant has yet to gather the documents relied upon....its only if you defend the claim will they then ask for disclosure from the OC...and if it cant be located they then discontinue the claim.....so that's not a factor on considering litigation.

We could do with some help from you.

Just an up-date and a re-cap since my last post.

 

Originally CCA'd Cabot and Apex last year.

 

Received letter from Apex advising that account sold to Cabot Financial and that both companies are part of Cabot Credit Management Group ?

 

I received the usual fob off letter from Cabot (40 days proviso) advising that they could not provide original signed agreement and therefore unenforceable but would contact the OC.

 

No further details from Cabot or Barclaycard.

 

I have still been receiving monthly Transaction Notices from Apex since I stopped paying.

 

January 2016 received Default Notice from Apex.

 

February 2016 received Agreement Termination Letter from Apex and that they reported to the Credit Reference Bureaux.

 

Do I just ignore or should I be sending a reminder about the provision of original agreement ?

sadly they are the account owner so will send account statements

and can mark your file

Should I contact them and arrange a new payment plan or just ignore and accept file being marked ?

 

And if the account had been already defaulted can they default it again ?

they cant change the original OC defaulted date

paying wont improve your file

 

 

and they've yet to comply with an enforceable CCA

 

 

so I know what i'd [not] be doing..

But what concerns me is if they add another default date entry on my credit file.

 

They have done this on another account where the OC had already entered a default date and Cabot have now added another.

 

Sorry if misunderstood but I would like to address now if need be as reviewing my credit file.

afaik, a default cant be doubled or more for the same account, otherwise it cld be neverending. a new owner can put their name on an existing default instead of the OC, but they cant renew its date or add another 'default'. see the ICO guidance etc on defaults.

if there is an actual ccj (judgment) then that will normally be added to a cra file.

you write to them [with proof of the old defaulted date etc]

 

 

give them 14 days remove the account or you'll report them to the ICO

and seek compensation.
