Hi everyone,

 

well i think I'm armed and dangerous, I've spent hours reading through the info on here and everyones threads......its very addictive and empowering! :D

 

Today is the day for my MCOL to be filed. I'm going for just over 5k from HSBC :x

 

Is it just me or does it seem to be taking longer now than it did for these to be settled? Looking at threads for claims back in May it seemed a relatively fast process, mind I guess with all the publicity there are just more and more claims going through now.

Has anyone got any ideas?.......

 

I'm due to send my MCOL today but can't afford the £250 court fees till payday at the end of the month so its going to have to wait.

 

Am I not helping my case here...will the bank think I'm not serious if I don't stick to my time plan? And should I send them a letter stating that I will be claiming in court,...as it is I've heard jack diddly from them so far.

 

:confused: :confused: I'm panicking now, want my money back but am stuck as they did me for yet another £135 this month grrrrrrrrrrrr

Yes me. I issued at Manchester in person last Wednesday and served them Recorded Delivery same day. Waiting for the Ack now. Have been doing a count down of how long on average it has been taking as I really hope and pray I get money back before Xmas. I served the Schedule of charges with the Proceedings with a view to making it quicker. I think we are looking realistically at early in the New Year if you allow 14 for ACK then 28 for Defence then they have to offer, accept and pay. Oh well Auld Lang Syne maybe a champagne toast for us Babs

Well looking at everyone else's threads I think you can so long as it doesn't go over the 5k mark, having said that, mine was over by £35 before costs, interest and new charges so yes, I've done the two in one claim....still waiting to see.

It's 14 days to acknowledge, plus 14 days to submit a defence. A total of 28 days.

 

Perhaps you'll just have a lot of money to spend on New Years Eve!

I'm at the same stage, should have heard from them last Thursday but nothing at all - seems to be a bit of a theme here doesn't there? A friend of mine claimed earlier in the year and they were settled with 13 days after the LBA but they do seem to be stopping that, maybe there are people who don't go to MCOL and they're taking a gamble, but to be honest my claim goes up to over £3k from £1.4ish with all the interest so it doesn't really make sense.

 

Have been away for the weekend though so I'm looking to file the claim either tomorrow or Wednesday. Have got to read through everything a lot more now though as this is serious territory and a bit worrying. Would love to get everything settled quickly.

 

Will keep a watch on yours and keep you posted also - and good luck to you Jayne too - its too scary all of this but definitely worth it.

It would actually be better if you heard nothing. Then you can press that 'Judgement by Default' button and you've won.

 

Until they moan to the court that they didn't recieve the papers, and they were away that day, and it's not fair 'cos we have a really good argument and we want to submit it and if that lady wins then we'll cry and we're the bank, do you know who you're messing with Mr. Judge. Etc....

Best of luck to everyone. Its just a matter of time! If you have 2 claims and the total sum of 2 claims takes you over the 5k I think its best to issue 2 claims as that way you keep them under the small claims limit so you are not on any risk on costs

Just to let you know they are pretty disorganised at the moment.

 

I got judgement after 14 days as they didn't acknowledge in time.

 

However they didn't like this and claimed that they had lost the papers in internal post and the court have allowed them to enter an application to set aside the judgement although I am passed the 28 days today !!

 

Not sure what happens now.

 

Best of luck - lets all keep the pressure up

Mark that is awful!!

 

But it does show that they really are beginning to dig their heels in a bit doesn't it, rather than just send out the settlements.

 

makes me a bit concerned that we could be seeing our first test case soon too

They have got to be looking at the implications of a test case now

 

this issue is getting loads of publicity now.

 

Didn't want to be the first but hey bring it on. I have experience of the computer systems they are using having developed them in the past. Lets argue the costs !!

This happens all the time they apply to have Judgment set aside as they havent recd the papers and they will get it but you should get the costs incurred and thrown away by the Application. as a matter if course they have to have the Judgement set aside to protect their clients interests rather than because they are choosing you as a test case. If they were going to do that they will do it on some of the biggies and apply to have it heard in the Mercantile Court IMHO

Yes, thats a worry, the mercantile court.....I was reading that quite a few cases from the Cardiff general area (i'm newport which isn't very far away) have been referred to the mercantile court and are awaiting the outcomes of cases there?

Whats that all about?

Our account is in Cardiff too - but the Mercantile court cases aren't v HSBC - thank god for that

 

I'm beginning to wonder if its worth all of this worry - it is isn't it?!?!?
