Hello,

about four years ago a company (which now no longer exists) began an unenforceable credit agreement claim for me against capital one. They went through the initial stages, and I never heard from Capital One again. Then yesterday I received a statement from Capital One. Since the original company that was dealing with this no longer exists I would like to continue the original claim. It will be near impossible for me to find the documentation from four years ago. I would really appreciate advice on how to go about this and any links to template letters.

Thank you.

Can you provide a little more information about this claim. Is it PPI / Charges and did you use a fee charging reclaim company ?

You might be able to obtain statements etc, by sending a Subject Access Request to Capital One. What other documents will you be needing ?

The SAR will cost you £10.00 and Capone will have 40 calendar days in which to provide this to you.

Hello,

thank you for your reply. It was not a PPI claim. I paid a company to prove this was an unenforceable credit agreement. It did go through the initial stages and my understanding is that judgement was in my favour as Capital one could not provide the relevant details/paperwork. ###should I still make a SAR request and would this include the details regarding my claim?

Thank you.

Hmm, did you pay the claim company any money ? When did you first start the original claim ?

I would think before you start any claim against Capone, that you obtain as much information as possible. A Subject Access Request would be the best way to go about that.

I would have thought if the claim had gone ahead and Judgment was in your favour, then you would find this within any paperwork provided to you by Capone.

If there was a Judgment, then you should be able to obtain the paperwork from the court that heard the claim ?
