Can someone point me in the direction of a letter/template i saw quite awhile ago on here,

 

im looking for the one which says about NOT giving a debt collector sensitive information

(im trying to set up a payment plan and they have asked for EVERY detail of my illness and income etc)

 

 

i refuse to give it to them,

as i dont know where it will end up,

but im sure there is a much better worded letter

on here somewhere just cant find it! thankyou

Thank you for reply but no thats not the one,

 

it was something along the lines of,,

 

, i will not give you any personal sensitive information as not sure whose hands it will go to,

 

think if quoted some guidelines from oft or something???

 

if not is there anyone who can let me know do i HAVE to give this information to a dca of a payday loan company??

 

!and if possible word a short draft for me that will be effective!!??? thankyou

I would quite frankly not be giving ANY info at all

 

let alone medical stuff.

 

whats the debt all about

 

and who is the DCA.

 

tell us the debts story please.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

At the most, a basic unsecured creditor should see a budget summary. This shows your willingness to pay but at a lower rate, plus it provides proof of your finances. They are not allowed to see other details. They have zero need to see them.

Can you give us the name of the DCA and the original creditor? It isn't a PDL is it? I ask because this kind of thing is pretty much standard for the muppets that own and run PDL's.

it was with minicredit! now their inhouse team! OPUS!!

 

any wording I could use to say no im not giving it!

 

anything official etc from OFT/law etc I can use to get them to back off and accept MY offer that I can afford and nothing more??

There ya go. Thought as much. This outfit always do that. Tell them to bog off but send them a very simple budget summary. They dont have a leg to stand on then.

thank you both for your comments, I will tell them they will be getting £?? per month, I still have their banking details etc so will use those and pay each month until cleared, as for information they have asked for they wont be getting it! apart from renagadeimp's suggestion. thank you again.

I know some people may not agree but I sent my creditors a copy of my ESA award letter (minus NI number etc) . Bugger the expenses bit .

 

However if I was working I would be using an I&E planner and double checking my expenditure against the guideline figures (sometimes called the trigger figures) .

 

If you feel nervous about doing it yourself give national debt line a call , I have always found them very helpful and a calming influence when things get on top of me

Hi fletch. Everyone has a right ( as you did) to send whatever they like to their creditors. Cag's advice is to play it safe, but make sure you follow procedure so they cannot say that you havent cooperated. As you know, give a PDL even an inch of room to breath and they'll push as hard as they can for more.

I absolutely agree and to be honest I only suggest sending any sort of I&E if it is of use to you. That is why i was happy to send my ESA award letter in. It didn't give details just that I was on a means tested benefit. So for me, in one fell swoop I showed them that I was ill, had no money and if they took action the likilhood of them seeing a return on their fees even was remote.

I agree, being seen to cooperate just enough is great . I do feel that if you are on income based benefits, that alone should be enough to get them to hold off

 

I&E's can be very tricky things to get right , sometimes you have to justify over threshold expenditure for example if you travel a long way to work , or in my case at one time paying some mortgage on one property where my ex lived and rent where I lived. I had someone help me who knew how to play the game shall we say . The way i treat PDLs is not right for everyone especially if you have an income or assets but touch wood so far it has ****ed them off so much they have moved to easier targets.

 

This may also be why I disagree with people ( not suggesting you ) because I know there is no one size fits all, some people are more able to deal than others for whatever reasons, I think most of us who have been there with the letters we throw away the phone calls we ignore and then the train hits the buffers and you have no money

Thank you all for your help, it is much appreciated,

 

would just like to add to the above comments from today,

 

when I first started to sort out my debts,

due to my illness and hubbies redundancy,

not our fault, but had so many sleepless nights,

so much stress which didn't help my illness,

was worried sick, hated the phone ringing,

hated the post man calling, but

 

now is a different story,

 

sometimes I still come back on here to ask for advice, as above!,

but I have gained so much knowledge and advice from this site

that I actually DO NOT let myself get into the state of despair again

because of some debts, especially pdl !

 

I can now word my letters so strongly but with accuracy and facts,

facts that I can quite happily quote from law etc !!

 

and from advice on here,

and know they don't have a leg to stand on in most instances,

and that ive rarely had any refusals to the monthly payment I CAN afford!

 

just want others to know you can do it,

 

you can stand upto them and most of the time you can win!

 

if win is the right word to use,

 

but in my case I win because I PAY what I know I CAN afford

 

and not what they think I should pay,

 

and I DO NOT pay their excessive charges either!!

 

couple of years ago I would not have been able to do this without the help of the brilliant people on the site..

 

.....so thank you all. still have a way to go to clear some debts but one day I will be free!!! :)
