Please help my daughter/ motor mile finance

Hi everyone

I really need some advice please bear with me as this may be long,

 

 

My daughter has serious mental health issues she has never been in employment due to this and needs round the clock care!

 

 

About a year ago the phone started constantly going

I can not remember the company but they were collecting on behalf of Wonga!

I told them to write all details to me as I couldn't get anything from My daughter about this!

I also contacted wonga asking what this was about and why they are claiming to have loaned nearly £1000

to someone who has no income other than disability benefits

and to try find out as much information as possible but have never received any reply!

 

Everything went quiet and to be honest I forgot all about it until

 

 

last week I found my daughter screaming down the phone in tears

 

 

I took the phone and went into her call log and found 48 calls/ 9 texts from the company motor mile

this was in the space of 4 days

 

 

They had called her 10 times within 2 hours!!!

 

 

I was absolutely furious so

 

 

I emailed them to make a complaint telling them never to call her and to keep everything in writing!

 

 

the next day they emailed me which I found quite threatening and I am so glad it never went to my daughter

It said we are contacting you about a loan you had with Wonga

we are now waiting on you phoning us to arrange a doorstep collection or we will make our own arrangements

if you do not want this we recommend you pay us a lump sum today

if we do not hear from you we will send someone to your home!!

 

I replied telling them they have no rights to send anyone to my daughters home

and to my horror they have just send me another email stating home appointment

and they have said they have made an appointment and someone will be going to her home!!

 

Please please tell me how I can stop this!

I haven't told me daughter someone is going to the house yet as she would get in a complete state!

I am going to bring her to stay with me for a few days and maybe speak to her support worker about this!

 

I have kept a log of all calls made to her and texts and the emails!

I have also set up her mobile only to accept calls from family/friends and her support worker etc!

 

Any advice would be greatly appreciated

I apologise for any spelling mistakes ect

I hope you can understand what I am asking!

Phone the Citizens Advice helpline for Trading Standards, to see if someone from Trading Standards can contact Motor Mile Finance. Unfortunately, this is not a unique situation and there are many such complaints.

It is obvious your Daughter has obtained a loan, when she should not have done so, Someone needs to contact Wonga compliance department with details of her medical situation, to register a formal written complaint with them. Wonga will have a process for dealing with this, which should be to stop interest and charges being added. Perhaps Wonga should never have provided the loan.

We could do with some help from you.

I shall phone them today,

 

 

I did contact wonga a while back to try and find out about the loan they claim she has taken out!

 

 

As I can not understand how on earth she would be given a payday loan and what it would be for!

She doesn't go out or anything both myself and her father would provide her with anything she needed!

 

 

She also suffers from black outs/memory loss so it is very difficult especially if it is going back a few years ago!

I've been through all her letters she has like bills, Council letters, dwp letters going back 3 years ago

and I can not find anything from wonga!

 

 

So hopefully they will provide me the answers because if I keep asking my daughter

i'm worried how she will react as she can completely break down or harm herself or lash out!

 

 

Its all very difficult she has a number of mental issues and there is absolutely no way she could handle the likes of this company!

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Are you sure your daughter took out a loan and she hasn't been scammed using ID theft?

 

A lot of this is going on with Wonga at the moment as they don't seem to fussy about their ID checks.

 

Mention of involving the Police for fraud should put Wonga down.

That's the thing Homer at the moment I am not sure about anything! I'm waiting to hear back from Wonga now, Also one thing I have noticed is they are not using her proper name! As in her full name which is the name she always uses the name that is on her bank account ect! I actually have no idea whats going on! She's asleep just now as her medication is sedating but both me and her father are going to have to try speak to her later again! We just need to try and approach this correctly :/

You need one of brigs letters for this. Failing that you may need to consider legal action. Mmf have complete disregard for the law and think they can do anything they like.

They have now text her which has got through to her mobile from another number 07860030636 once again saying they have arranged a home visit! I hope wonga gets back to me soon or I will need to change her mobile number! I really feel so sorry for anyone having to deal with this company alone! My daughter jumps when the post man knocks at the door imagine getting texts/emails saying someone she has never met is coming to the house! It makes me mad! What is a brigs letter sorry?

Why have you not contacted Citizen Advice Trading Standards helpline that I linked to earlier ? This is the type of situation they are set up to deal with.

 

Brig is a poster to this site, who on occasions will draw up letters people can send. He has also dealt with many complaints, recently MMF in particular. In this situation, you don't need a letter. You just need Wonga to deal with this. I would see if Trading Standards will assist, if need be. They can at least register a complaint about the way MMF have acted.

I will phone them as soon as I can! I have to wait on my husband coming in so I can use his mobile my landline is incoming calls only I have tried to use my daughters mobile but its not ringing out and she is still asleep it may need topped up I'm not sure how to check the balance! I have emailed wonga! And waiting to hear back from them!

Wonga wont deal with it if its been sold on. WE've had plenty of posts from people that have had the same thing done to them.

Dear Mr Sands.

 

Ref: Miss xxxxxxxxxxxxxx: Alleged Wonga Loan:

 

I refer to numerous threatening and abusive contacts made by MMF Ltd., regarding an alleged debt arising from a Wonga Loan for £xxxx.xx supposedly taken out in the name of Missxxxxxxxxxx, please take not that Miss XXXXXXXXX has no knowledge of any such debt and does not accept any liability for it.

 

For your information and for clarification Miss XXXXXXXXXX suffers from severe mental health problems and would not have the capacity or ability to apply for such a loan.

 

The conduct of the staff of MMF Ltd., is appalling and has reduced Miss xxxxxx to tears and caused extreme anxiety and alarm to the extent of sever harassment

 

I would point you Mr Sands to the recent Appeal Court Roberts - V- BOS and their Lordships findings in regard to harassment.

 

MMF will be reported to the FCA/OFT and a complaint is being considered to the police.

 

MMF Ltd., WILL now remove all data relating to Miss X from its records immediately and will confirm in writing that it has done so.

 

It is quite clear that MMF Ltds conduct fall far short of that required by holding a Consumer Credit Licence.

 

Given the immense effect that MMF Ltd., has had on Ms Xs already troubled life I would suggest it Must make a considerable financial redress for its appalling actions and it should bear in mind the amount that would be awarded by a court in this situation.

 

As this is a most serious matter I would expect MMF Ltd., to respond very promptly to this formal complaint and not to wait the normal 56 days to reply.

 

This complaint is made on behalf of Miss X and with her knowledge and approval.

 

Get this off asap and please don't phone MMF, come back here at any time and I will pick up on the thread.

Hi there

sorry I have not been on to keep everyone updated on this matter

but unfortunately after doing everything and contacting everyone recommended to me above

things got worse.

 

The constant threats would not stop

not only were they threatening someone to go to her house

they also said this person would be taking photographs and assessing her lifestyle!

 

I made them aware of everyone

I reported them to to be told the OFT guidelines on door step collection does not apply to them.

 

So after everything and becoming ill with stress myself my daughter has moved out the flat and back in with us!

 

Her mobile number has been changed also!

But the emails are still continuing but at least they come to me.

 

I'm just to ill at the moment to deal with it anymore and my husband works long hours.

 

I thought after contacting trading standards and the oft on numerous occasions

and making them aware of this would stop things but it never and things just became to much for me.

 

Thanks again for all the advice above but this company just doesn't seem to care.

Get in contact with the police - You may need to be assertive in order to get beyond the front line desk jockies and get through to the correct unit.

 

The fact that these calls and threats have caused distress and resulted in your daughter having to abandon her flat amounts to harassment and stalking - Keep badgering the police until they do something about it, what this company is doing is a criminal offence.

I think its time you took legal action against them for harassment. Rob sands has some serious explaining to do

May I suggest the following, unless you are prepared to see this through to court action for harassment it would not be appropriate to send a " letter before action" but I can draft a letter for you that comes close to it If you wish.
