i sent the letter above, they recieved it on the 18th i dont suppose they'll take any notice but it buys me time untill i get payed then i can pay the court fees, as for what you should do if you can afford it just go to court you've given them enough notice, i only wrote to them hoping it would save me the court costs but im not holding my breath, GO GIRL.

well ive finally raised the £250 needed, so ive filled out the N1 ready to go to court tomorrow, and waiting for me is this

can someone point me in the right direction please, my claim total is over £5000, so i want to read up on how it went for others who were successfull, also i will have to answer a cpr18 request, any pointers please, forewarned is forearmed , or so they say

just one question michael, my claim is for £4274 + £764.61 interest, i had to pay a £250 court fee, so this means its not a small claim but a fast track claim, correct or not? can i ask for the small claims track?? its just reading through the successes hilsey had a claim over £5000 but still went small claims track.

Hey saint, haven't heard from you for a while. Natwest haven't replied huh? i have been trying to get my head round this last process and it is like you say cobbets leave it until the last minute maybe you may get something in the post tomorrow, i don't think i have seen anyone on here go to court.

is this the stage you are now?

 

The bank will now either....

 

A) Ignore the claim completely - they can claim incompetence as the reason for not Acknowledging or defending and you win by 'default' after 14 days. You will need to apply for a judgment which you should do as soon as the time limit has expired.

 

If they get a defence in before you apply for the judgment, then they gain the right to proceed into court if they want.

 

B) Acknowledge the claim - this buys them a further 14 days to enter a defence. Some banks will acknowledge the claim and then pay up. They know you MEAN it now! For every threat that gets this far, there are many more that give up long before this point and they know it.

 

Some will acknowledge the claim, but 'forget' to enter a defence - after 28 days from the date the papers are served on them you will have won by default and you will get all your money back. Once again, you will need to apply for a judgment. If they do not pay you in full, you have every right to send the bailiffs in - this can also be done from the moneyclaim.gov.uk site or by applying in person at your local court (if you started your claim this way)

 

C) Settle the claim in full, including interest and court fees (if they offer to settle for anything less, then refuse - YOU WILL GET THE FULL AMOUNT)

 

D) Submit a defence. If they do this, the court will send you an Allocation Questionnaire form to complete. This is quite straight forward and, once again, there is help for completing one.

 

 

Can i ask though, when you filled in the N1 form did you get it from this forum or the court and did you use the spreadsheets on here for calculating your 8%?

thanks, i have the N1 form now from the site but the excel spreadsheet i was looking in the wrong place. My gosh the vampiress chambers site is a bit scary :eek:

 

I hope someone answers your question soon. Hopefully you will be getting your money quite soon

you cant download the N1, so you have to fill it in online & print 3 copies, the spreadsheet was so easy to use, well it has to be if i managed to use it

Ah bless, i think i know what you mean it is totally different reading someone else experience but to go through it yourself is a whole different ball game.

 

i suppose you just have to keep calm, there is light at the end of the tunnel. I haven't read anywhere that people have been to court

you're right there, the're not going to court so its just wait,

some people have been paid out after the prelim today, so they maybe changing tactics, but for me some sod turned the light out
