On Friday last week, we had a technical issue that erroneously sent you an email statement for your Lending Stream loan number xxxxxxx0. Please disregard that email, as it may contain inaccurate information.

 

 

All a bit weird

 

A bit weird????? this is MMF = did you receive such an e-mail if so keep a hard copy safe somewhere.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

My guess is some muppet has sent inappropriate threatograms but MMF have no idea who to, hope it hurts them.:madgrin:

FIrst, they cant add anything unless its stated in the T&C's of the original account.

 

Second, did you contact Rob sands?

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Not heard anything from Mr Sands

 

Have however started getting the emails again and they are not very nice

 

This was a generic one i think a few days ago

 

"Dear Mr

 

Please contact Motormile Finance regarding your outstanding account on quoting reference M.

 

Yours faithfully

 

MMF"

 

 

Ok fine but they have still not returned any of my previous emails.

 

And this one tonight which is horrible

 

SUBJECT DOORSTEP ASSESSMENT

 

Our Ref:

Debt Details: LC

Debt Value: £

 

Despite attempting to contact you on numerous occasions we have, as yet, not received a response and are now reviewing this case for further action.

We are considering whether to sanction a visit by one of our Field Agents to your property, with a view to discussing this matter in person and reaching an mutually beneficial repayment arrangement.

 

Alternatively we may decide to pass this account to our in-house solicitor with a view to issuing a claim against you in your local court.

 

We must advise you that should any legal claim prove successful the balance of the debt will be increased to include any legal fees and court cost we incur and that your name will be entered in the Register of Judgements, Orders and Fines.

 

We would also look to enforce any successful judgement granted, by way of an Attachment of Earnings (AOE) order (where applicable). This may resul t in your employer being contacted by your local County Court.

that's against every guideline in the book!

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I would reply back to their email using the phrases I've marked in red.

Despite me writing to your Compliance Officer you have failed to reply in a coherent manner, therefore again I revoke any Field Agent visit as there is nothing to discuss and the only mutually beneficial arrangement they can do is to bring me a cheque for £1000 for your persistent harrassment of myself.

 

Alternatively we may decide to pass this account to our in-house solicitor with a view to issuing a claim against you in your local court.

Would you like to add an email to my work email saying they will visit me even though I have not responded, a recorded message on my work voicemail and then a recorded message on my home number at 5.30pm this Sunday evening to your list of complaints? The message at home was not even a real person - it went straight to the recorded message!

I need help reporting them to the relevant authorities

 

Had a nice letter from oft today re motormouth they say they will consider my complaint along side other they have revcieved to a view of thir consumer credit license

 

People must send complaint in to get rid of these people

We write further to our recent communications that you have recieved from this company putting you on notice that the balance of £remains outstanding.

 

This week your file is schedculed to be passed to your local Home Visit Division.

 

We are happy to try and resolve this matter without conducting a field visit and we would ask you to contact us by telephone or email to discuss repayment terms. Alternatively you may make an offer through our website at http://www.mmile.com. or return the standing order form attached to this email.

 

Please note that if we do not hear from you, then you will be visited, at your residential property, to assess your personal circumstances with a view to passing the matter to our Solicitor, should a realistic repayment agreement not be met.

 

We would, lastly advise that if you are able to make a lump sum settlement offer, then we would accept a settlement payment of £ in full and final settlement. This offer will lapse in 5 days.

OFT has no authority to become involved in individual disputes and agreements

between consumers and traders so we cannot advise you directly in this matter.

 

The Financial Ombudsman Service (FOS) can help with most complaints about

consumer credit products and services if the consumer has failed to satisfactorily

resolve the matter directly with the consumer credit licensee itself. FOS can be

contacted at: Financial Ombudsman Service, South Quay Plaza, 183 Marsh Wall,

London, E14 9SR; 0845 080 1800; or http://www.financial-ombudsman.org.uk.

 

I can confirm that the business you mention holds a consumer credit licence. Under the

Consumer Credit Act, holders of consumer credit licences must be fit and competent

to do so and the OFT has a duty to monitor the fitness and conduct of all traders who

hold such a licence.

 

We have therefore noted the details of your matter, and we will consider this alongside

any other complaints we have received with a view to any consumer credit licensing or

other action we may decide to take. If we do take any action against this trader we

may need to contact you again in the future. Unfortunately, we cannot disclose any

details about any action we may take, due to legal restrictions on the OFT relating to

disclosure of information.
