Hi this is my first post, I have defaulted on my loan .. And using a template that I found here I emailed wonga with a payment plan through my own email and not the site ..

 

My debt with them is almost £1200. Prior to this I cleared my account and blocked my card ... Had a stand off with my bank about CPAs for 90 mins in my local branch to which they said it was not possible to cancel CPA and that it was my responsibility ect..

 

They would not stamp or copy my letter requesting cancellation of these payments nor would they give me,in writing,their refusal to comply...

 

I left the bank with a copy of their terms and conditions that they provided me with and said it was they best they could do.. 30 mins later I receive a phone call from the manager of my bank saying "oh yes, I'm sorry this is new legelation and in fact they can cancel these payments and she stated there is a marker on it now..

 

Though I still don't have this in writing ...

 

Earlier to day I receive an email from wonga with a payment plan, ... Thing is it is addressed to the wrong name and has the wrong loan amount and repayment calculations attached ..

 

I would like to point out that the repayments are considerably lower than I proposed... Somebody please help me with this situation and advise me on wher exactly I stand

My first thought would be to get a complaint into the bank and fca. Its not new legislation. Its been around since 2009

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

They would not stamp or copy my letter requesting cancellation of these payments nor would they give me,in writing,their refusal to comply... Nope, they wont - it is called abdicating responsibility and lack of customer service..

 

I left the bank with a copy of their terms and conditions that they provided me with and said it was they best they could do.. 30 mins later I receive a phone call from the manager of my bank saying "oh yes, I'm sorry this is new legelation and in fact they can cancel these payments and she stated there is a marker on it now.. Aha.. the message has got through and the penny has dropped - if they don't comply then they can be fined and have to pay you some compensation :) This is not NEW legislation, just that the new regulator is showing their fangs and the banks are having to do as they are told.

 

Though I still don't have this in writing ... Just keep your copy of your letter - mark on it that the bank refused to give you a receipt for the copy you left with the bank. Also make a note on your copy that by the time you got home, the bank had read the rules and realised that they DO have to cancel the CPA and they have advised you this has been done. Make sure you check your bank statements over the next couple of months to ensure that they have cancelled. If they haven't then we can help you make a serious complaint :)

Righto. Now this is a little more serious. Wonga have breached DPA rules by giving you details of another Wonga client. Does this mean that they have passed on your details to another person ? You need answers to this immediately.

 

You must contact Wonga immediately and ask them what they are playing at. I will ask someone to help you put together a letter that you can email them.

Yes I did insist that if they would not take a copy of my letter regarding CPA I would then like a letter explaining their refusal to comply in order to make a complaint and they also would not budge.. I don't know what happened after I left but the made a phone call to myself stating that it is "new" I even read them out the regulation. I was going to have a protest but the cashier insisted on shouting my business around the branch ... Looking at my letter Her words " I don't know where you got this,whatever it is,from but it was yoooou who took out the loan from wonga and so it is yoooou who needs to come to an agreement with them, it is not a matter for the bank I'm afraid" I could have died with embarrassment

Renegadeimp, what do you make of it all .. I have read your advice on here and you are spot on so thank you for that :) I am miffed about this email I received addressed to the wrong person?. What should I do next?

Thank you citizenB .... Yes they have sent me a payment plan for another person ... Definitely not mine!!!!!! Considerably lower in fact ... I am assuming that this person has received my payment plan... I have no idea .. I'm at tipping point with it all ... I would be great full if you could help me with this .... All of you guys are a real god send ... I was tearing out my hair at the roots before reading you advice on here

I think you should certainly make an official complaint to the bank. Not the branch, to their Head office.

 

Explain everything that occurred and let them know how unhappy and embarrassed you are at the treatment you received.

 

To Wonga, you need to contact them by return and advise that on DATE you made a request for a repayment plan. Today you have received an email agreeing to a repayment plan - but it is obviously meant for someone else (give the details you have been sent).

 

Could they please respond to your request as per your communication dated DATE and further explain why they are providing another Wonga client's details to you. Can they confirm/ assure you that your details have not been passed on to someone else in breach of Data Protection !

Thank you all so much for your advice ... I'm feeling a wee bit out of my depth with these guys including my bank, and feel I need my hand held a bit here ... Should I have arranged a payment plan through their site or was doing this directly from my own email suffice? Also,do I reply to the email that they sent me that included this other unfortunate individual? Or a new email ... And do I send the letter regarding the CPA to my banks head office or charge in there tomorrow gloating and ask them to date and sign it now they have admitted their "mistake" .. And do you think I may have a little ammo for wonga now that they have sent me another individuals repayment plan?

I've often said that Wonga do appear to be the best of a bad bunch lol (that's still not very good)

 

Follow the above advice about the serious breach in DP.

 

When I emailed Wonga offering them £80 a month I was surprised when they emailed back saying they couldn't accept this amount per month but as a gesture of goodwill would accept £40 a month and freeze Interest??

 

Because I had everything in email I gave them debit card details for an account I didn't use and paid £40 a month Into that account. I continually monitored it and they kept to their side of the bargain.

 

 

As for the bank cashier embarrassing you like this... You must pursue a complaint. Take it right to the top. In my own job I'm expected to treat our customers with a bit of respect, I am damn sure that if I'd have embarrassed a customer like that with incorrect guidance and advice I'd be signing on by now!

Yes ... The more I think about it I'm getting so angry! ... I do know I got myself into this pickle and will get myself out if it .. I will email wonga right now and await a reply .. Will I return the wrong email they have sent me as in I reply to that peticular email if you like? :/

Before you proceed much further....

 

Out of curiosity log in to your Wonga account online and on the left hand side of the page it should tell you the current amount you owe and also if a repayment plan has been set up it should show the amounts and dates also.

 

Would be worth checking this out before contacting them.

 

Definitely also focus your anger on a strongly worded letter of complaint to your banks head office.

Could I just ask someone out there in the know if an email to customer services @ wonga is suffice without sending a repayment request form from their site ... Also in replay to bombaymix no they haven't set up my repayment on the my account page

Ok just an update ... I have received a text fron wonga stating my loan is still due and to log into their site to pay in full or set up a repayment plan as intrest is still being added

 

I don't want to give these guys any new details of my bank acc or new card otherwise I will undo the CPA saga with my bank. Advice would be much appreciated.

A lot of basic bank accounts don't do Debit cards & Direct Debits. Simply advise Wonga that you can only do Standing Orders, so they must give you THEIR bank details.

 

In fact I think they are breaching OFT guidelines if they refuse to allow you to pay in a manner you are comfortable with.

I have asked them to provide me with their details on my initial email .. I have obtained their bank info on another post here.. Would it be daft to pay without their consent or a payment plan in place ... I would like to start paying back what I have outlined to them in my proposal but as yet I have had no reply :( when the contacted me through text message I sent them another email to remind them to only contact me via email and to please respond to my previous emails including my request for their explanation as to why they provided me with another individual repayment details.

Am I doing something wrong here, do I keep waiting all the while my intrest is accruing :( :(
