I bought a BMW 3 series (2007) from the Cargiant Ltd, White City, London, just under six months ago now. At the time of purchasing the car the salesman went on about half an hour talking about the AA warranty and assuring me that the warranty covers all the parts and labour he even went trough various components of the car such as fuel system, engine, etc. So I bought the warranty cover for two years costing me £699.00. A month ago the car developed a fault,

I contacted the AA warranty and they sent me to their designated repair centre.

The garage could not diagnose the fault and told me to take it to a specialist.

The AA warranty service did not bother to get back to me at all so I had to wait on the line talking to different people to explain the situation to which they just replied: take the car to a specialist.

 

I then took it to a specialist for repair. It cost me just under £1000.00 to repair as they found fault with the fuel system. This is now on top of all the time and money that was wasted because of the incompetence of the AA warranty repair centre. However, the AA warranty then refused to pay stating that the repair is not carried out by their designated garage.

so I am lawfully entitled to a refund according to SOGA. However after many weeks and many phone calls and emails to the Cargiant, they did not even bother to return my calls or emails.

I suggest that you write to Car Giant about this. Do it straight away - by email if you can and keep copies.

 

I have no idea why you would want to spend this kind of money on an extended warranty when you are covered pretty well by your statutory rights.

 

You are covered by the Sales of Goods Act and the car must be of satisfactory quality and must remain so for a reasonable period of time. What is satisfactory depends on the circumstances - but I would expect that it would not be satisfactory to have to meet a £1000 bill in the first 12 months - and probably longer.

 

Write to Car Giant or better still, go and see them with the car and see what they have to say. Stop doing things on the phone without recording your calls. You are asking for trouble if you do this with any company.

 

So far as the AA insurance is concerned, they are acting in breach of the insurance regs - ICOBS rule 8.1.2 which basically says that they are not entitled to reject claims merely because of something which does not affect the risk - such as a designated repairer or failure to meet a deadline.

Do you have their refusal in writing?

By the way, do you have evidence of your emails sent to Car giant? If so please would you post them here.

Thank you for your comments. The AA warranty people did not contact me at all with regard to this issue. I had to chase them call after call. I even asked the main dealer, who repaired my car, to contact them and give them full detail. Basically I found it completely useless dealing with them as they keep repeating same words. Basically the Cargiant's salesman deceived me by lying about the warranty service. As I was skeptical, he went on talking almost half an hour about the service using different examples and assured me that any repair up to £2000.00 per claim will be easily covered. What a big fat lie, I know now.

I am writing to complain about the AA warranty, with the policy number xxxx, after recent several contacts with their claim and customer service departments.

 

I bought a car from you, with the registration xxxx, on the 10th January 2013. With the car, I was sold the AA warranty cover, which I did not originally intend to buy. However, I was persuaded vigorously by one of your salesmen that the said warranty is a very transparent and high quality service product, governed under the Cargiant safeguarding and only administered by the AA.

 

 

After less than six month, recently my car developed a fault, I contacted the AA warranty and they sent me to a designated repair centre in xxxx. This garage, however, was unable to rectify the problem and recommended to take the car to a specialist. I contacted the AA warranty again as they meant to provide further instruction and never did. After many calls to the claims department, they told me that I should then take the car to a specialist.

 

 

After taking the car to the main dealer and finding few faults with the fuel system, which is on the very top of the list of the AA warranty, they refused almost all the replaced components as well as the repair labour.

 

 

 

I strongly believe I was mislead to buy this warranty product. It does not match the description, it is not of satisfactory quality and it is not fit for purpose. Therefore I request a full refund of £700. "

Please note, as I have started a campaign to expose the Cargiant-AA Warranty rogue trading, they keep complaining to places that I have posted reviews exposing them. They said to two places so far including

moneysavingexpert and reviewcentre

that I have made the story up :) . I provided detail such as my policy number and some of my writings to these sites and I hope they make the posts available back online. Obviously the Cargiant has now started to realize that they are getting exposed and don't want other people to know about their dirty little secret.

If the Cargiant genuinely cared about their customer they would have at least responded to one of my calls or emails. I have by the way recorded the calls to their customer service with the names so if they continue to complain to the sites to take off the reviews, I will consider publishing names of the customer service representative, name of the salesman that very happily lied to me about the warranty service, telephone calls, etc.

I should also mention this, as I realized after the warranty was refunded, that the AA charged my credit card without my knowledge. I have reported this to my credit card company as an unauthorized transaction . The AA warranty as I have gathered is big fraud. I have recoded my conversation with them they don't even tell their full name!. Surely they must know what fraud they are running that want to hid their name. Otherwise what is the reason?

Hi, I have a similar problem and will be following your example. I feel I was mis-sold the policy and will be complaining accordingly.
