Hello again.

 

It doesn't really work to start a new thread for each query, at least not for the advisers. I'm going to put this with the other threads I just merged. If you find that you have a question unanswered, then I would say the best thing is to keep track of what you've asked and then if you don't have answers after a couple of days, raise it again on the thread.

 

Please keep to this thread for your queries.

Actually, though, the threads aren't for the same problem.

 

I see so many people told to put separate threads, so it doesn't get confusing.

 

That's why the different threads.

 

One is a et claim and the other is for a discipline hearing. Neither related to the other.

 

But if you think it is better this way, I bow to your experience.

Well, in my experience it does usually work, but if the forum guys disagree with me, I'll try to untangle things.

 

The point about keeping information together is to make it easier for the advisers here, as they don't always have the time to go hunting through various different threads to find it. This can mean that information isn't noticed and you get less complete advice.

 

I'm just trying to get you as much advice as possible. :)

re: vulnerable witness - if your questioning is aggressive you will only support their view that they are vulnerable. I would be inclined to let that sleeping dog lie. What do you gain by having them in the room? Not much.

 

re: magistrate lying - wayyyy too many what ifs in that scenario for me to hazard a guess!

He claims I threatened him in his office with no witnesses and then in front of three witnesses, outside the premises, said I assaulted him.

 

But I suppose it ends like all the threads we read, found not guilty of stealing cup cakes or whatever, but still no happy ending.

 

I know if I was chairing the hearing, I would probably side with the butter wouldn't melt Manager.

If you insist on having him in the rooms to "see the whites of his eyes" or similar it'll just add fuel to the fire. Leave it be. Seriously.

hey smoke check out the Emoyment Relations Act 1996 and 1999. A whole host of employment rights are in fact afforded to Crown Servants.

 

Crown servants lack a few rights that other employees are afforded but you will be surprised that a Crown Servant is deemed an employee in most issues, it's usually exemptions around withdrawing labour and political party membership, associated businesses etc that set crown servants apart from normal employees.

 

I have issues of my own with my employer and have lodged ET1 just sent what I want as part of my Compromise Agrrement to my solicitor and I am a Crown Servant

hey smoke I saw a binding case involving a Police Officer who was on a phased return to work following depression, stress and possibly PTSD anyway this officer was called into a meeting to discuss their absence etc and had a panic attack. the officer tried to get out of the room and the sgt tried to stop the officer. by all accounts the sgt received a slight injury as a result of being 'brushed aside' by the officer as they tried to escape because of the panic attack.

 

charges were brought and internal grievances and discilinary procedures etc led to a tribunal. the officer was cleared of any wrongdoing and it was judged to have been part of the illness, the sgt shouldn't have tried to physically restrain the officer to prevent them from leaving.

 

if I find the case in my files again I'll put a link - it's my OCD of researching things and cases that will possibly help me fight bullies and also win my ET that I find these things read them save in a huge file etc I must read up to 30 cases a day some days, depends if my wife hides the Internet box or not ;-)

It was only confusing because you feel unable to provide the full story. I can see nothing that requires the removal of your posts. However, I can and will close the thread to prevent others posting on it.

the article I read was in POLICE magazine, August 2013 edition, I can't find it on the online version but was in the hardcopy which is delivered free to police stations.

 

I may have mistakingly thought it was 'binding' as it was puished because I can't find anything on bailii regarding the EAT however it may still be useful with regards to directions at any PHR or ET

Well I got my copy of the magazine and this is exactly like my situation, I need to find the case details now.

 

Anyone know how I can get the case details for this PC W , tried all sorts of searches, even rang the solicitors who weren't any help.
