  1. looking at the agreement, is the section "right to cancel" containing enough info to comply. It says they will send you the details, surely they should be on the agreement ie; 14 days etc;

Employers should be restricted to using their own in house HR departments to keep costs down, if HR knew more about the law, then maybe they would get managers to treat their employees better/fairer, happy employees are more productive/increase profit. Exactly, stop the ET system just being a lip service and do what it's meant to do.
  4. More money for more lawyer's. ET starting to look a bit like divorce , only people benefiting are the lawyers.

  6. So now they are saying you should settle even if it's not to your satisfaction, They should just do away with this ET system, not fit for purpose.
  7. All you can do is show via the joint bank account what your husband contributes to the household bills. Whether your husband has money doesn't mean he will pay your debts and shouldn't have to. You can show what your income/outgoings are and what you have left and therefore can pay. That is the only information you have. The more I read and experience from this ET system, the more I despair. Employers don't seem to care about these proceedings, they are a minor inconvenience.

  12. Good advice, take the money as long as you can, you know you ain't going back, so no sweat. Have a few days away or a day out, whatever you used to enjoy. Do MOD have a rehab place or rest/break place, ask your union they should hook you up.
  13. There isn't a problem then, you aren't going back full stop. Severance, resignation or dismissal, they can take their pick just hand back the key to the executive wash room. Finished, just wait for your final pay packet. If you offered them severance or resignation, I think they are going to take the cheaper option .

Other peoples problems seem unimportant, because they are unimportant, can't find red nail varnish, car failed mot etc. Glad you are letting union etc just get on with it, I agree not a job risk matter, but the employer can't write that to you, it would show up the system ie; a through process needs to be carried out and not pre judged ( if you believe that ).
  15. I quickly read your other threads ( some ) after honeybees comments. I'm glad you are getting CBT it works well (although not for me ). I see a pattern in your threads and that it appears you worry about everything, CBT should help you with this. An example being the work college that mentioned your university leave. It's not easy I know, I can see ways round everyone else's problems but not my own, so I know the answer must come from in yourself. A good line I remember is "worrying is like a rocking chair, it gives you something to do, but doesn't get you anywhere". When you worry, try and think about the problem, why am I worrying. For example the university, most people would have told the college to mind her own business or ignored her and thought to their self what a prat ( or the term you use). The only reason to worry is if you did something wrong. I'm not perfect and not an expert, I'm going through difficult times myself. However when I am in a better frame of mind, I try to not let things bother me, just get through one day at a time, if you fail one day, so what, start again the next day. Let the person trying to cut in front go, don't get upset about the person jumping the que. etc. I guess you had the CBT example; "walking down the road Doris sees her neighbour on the otherside of the street, the neighbour ignores Doris and has a stern look on her face and walks at speed. All day Doris is worried about the neighbour, what had she done wrong, was her car parked too close, was it when she dropped the suacepan last night or was the TV too loud. The next morning Doris was waiting at the bus stop and the neighbour walked up, she said to Doris that she hadn't seen her for a while, Doris mentioned yesterday and the neighbour said she hadn't seen her and was just going into the bank to give them a piece of her mind about the bank charges ". Do what you want to do, if you want to resign, then resign. You have 2 experts in their field and in your organisation giving you advice. What they tell you should be reliable, if you have any worry s, which would probably be "what if's" then ask them. Another thing is perspective, when I have been in hospital, you can't do anything about the outside world, however hard you try and after a while you give up and start to relax and forget about your problems. But that may be why they put me in there ;-) Lastly , have you noticed, when you hear other peoples problems ( most, not all) they seem unimportant, have you thought why?
  16. ET is just lip service to the problems. fools us all in the beginning until we get experience. Like a divorce, only lawyers get anything out of it.
  17. There are ways round the time limit, possibly. Acas are rubbish, but you found that out quicker than most people. There is a new system where you have to go to acas first and this stops the clock. Employment tribunal is pretty cr#p as well, so unless there is big money involved you are best to forget it, not worth the trouble. I expect anyone considering employment action, to make research about the process, most if not all sites tell you the time frame. research on old posts would show people are always being warned about time limits. You can't bitch about no one telling you on here, everyone tries to help, but not many are legally qualified, it's nearly the same as someone down the pub telling you what they know. All is not lost, as I said there are ways round the time limit.
  18. What actually is at stake here. I understand racial discrimination, but to what extent. What outcome are you looking for, if money how much. If there is corruption, which I definitely don't dispute, you won't win.
  19. Emmzzi, knows her stuff and has a lot of experience, however I do see a lot of people getting upset with her direct, no no-nonsense advise. I like her answers, she's not here to tell you what you want to hear, so she won't pretty it up to let you down slowly, paid help will. You will have to read everything you can and find relevant points, only you can do that as your motivation will drive you or in the case of professional help, getting paid drives them .
  20. I think you hit the nail on the head when you said "it's worth sh#t all". Some employers do ignore the law/legislation, their attitude can be, well what you going to do about it. The judges will say to you that they are not there to punish anyone. On a ratio of effort put in to result/compensation received, I think the ET is a waste of time and if you get representation, money. I suppose the employer did consider it, but not how you wanted them to. The argument about the lower paid post is almost like making up a job, I see what your saying, but if someone is needed then they would get someone that can do a full week. As it is, sickness and holiday absence is usually covered by the other staff doing more work. It is frustrating when people don't see your point, but sadly thats how life is, we just shout, swear and kick something and then give up and move on to the next drama life has in store for us.
  21. Don't let the respondent take over, they seem to want to run the show. I'm not sure they go through the bundle, just read your statement. Get all your points across, spoon feed the judges, pretend they are thick and know nothing ( you really will be convinced that they are). Don't rest on your laurels because you have been told you have a strong case, work really hard to show it's strong and why. How long is it scheduled for. You may be lucky and they approach you with an offer, but don't bank on and be prepared. Good luck and please let us know how you got on.
  22. If it's irrelevant, then don't worry about it. From what I've read, they are not interested in hearing you are a rascal etc, just interested in what laws have been wronged. As I said, is it cost effective to get a barrister, the payouts don't seem to be fantastic, might end up out of pocket as you don't normally get your costs back.

Gather all your papers you want included in the bundle and send to the court, you have to send a copy to the respondents as well. take 6 copies on the day and number them so they can be added without confusion. Sadly the ET system does seem to be strange and its just another of the silly tricks that are played. You could ask for an "unless order" but I would just ignore it and not get stressed. I take it you are representing yourself. I'm not impressed with the system, seems a lot of trouble for little reward and if you get representation it might cost more than you will get. It seems from reading, that more people are going to the county courts to deal with it.
  24. Reread the original post, sounds al right I would tell it exactly as you did there. Also the supervisor should confirm the guys attitude and actions. In future don't let them get this drunk. point them out to bar staff and tell them not to serve any more and/or ask them to leave you will probably need to show them the door ;-)
