I am sure it was only ever 2,

 

 

I do not know where to start as the dates are duplicated,

 

 

I have older credit files at home I am going to check them,

 

 

I found that box last night,

 

 

in my hunt for the receipt!

what does this mean,

 

 

do you think I am going to come across more problems, now,

 

 

I cant belive this is all happening,

 

 

I found some older credit reports last year

 

 

I am going to have a look tonight and see if I can see any thing odd on them,

 

I am a member now of credit expert so I should get flagged up with changes they make now.

Crafty barstewards are suing you for a lone that you have settled

 

why have they a settlement date of 24/09/2008 when the account was only opened 23/07/2008

 

According to the statement 24/09/2008 that was when the funds were paid (settlement date)

 

The agreement provided is the 12/09/ 2008

 

This is really starting to smell bad

I am glad its not just me then :!:

 

I know I think that there has been one of 3 things happen:

1) the store were on the fiddle and have done well to cover it until they were shut down,

2) there has been an error

3) welcome are as confused as i am and don't know where to start.

 

i don't know where to start. I have looked at the statements and there is no big payment that we made, i know it was between 3000 and 4000 pound! i know i have the receipt we were given and will be celebrating when i find it.

I think it is best we start again for clarity

 

1/ how many loans have you had in total

 

2/ does the loan agreement provided match the loan you are paying now

 

THAT RECEIPT WILL BE DYNAMITE

 

WILL YOUR BANK STATEMENT SHOW THIS PAYMENT??

That is why the loans are marked as satisfied on your credit report

 

can you confirm if that payment you made to settle the account with welcome is on your bank statement, that will end this argument once and for all

its not

it was cash from selling a car we had.

 

 

I want to write to them and ask for copies of all the credit agreements as this is not my signature

 

 

I don't know what or who or how this has happened,

we were talking about it the weekend and

I wonder If the branch have been fiddling and

have made a new agreement up,

they said that the agreement is on credit report as started 23.07.2008.

but this agreement they have signed doesn't even have the right date.

 

I have three questions:

1) How do I apply for an extension of the date for defence as I think I need to get my SAR and copies of all the agreements.

2) can I simply write a letter and ask for the copy agreements and advise I am getting a report from a hand writing expert

3) the comments as above even on the default notice do I need to do anything on that also. there answers all seem pretty vague.

 

If anyone else has had a signature forged can people let me know , I keep hearing its common practice but do not have seem to have found anyone else.

Sorry if i keep asking the same questions, but it is important

 

Have you managed to find a receipt yet for that cash you paid welcome following the sale of your car

 

I myself have used expert witness testimony as to a signature on an agreement

 

You need to Google a graphologist to make an official report

 

Even though i had one done, it was never needed as i was already successful against welcome on other issues (Agreement failings)

I want to get an extension of the time to file a defence as I have been poorly with my heart and haven't got through the rest of the loft I will do it. I know its there. I also want to send a letter to see the other agreements, they will then see that the signature is not correct and that they dates don't tally up!

Simply contact the Solicitor named on the summons and agree an extension (quote CPR 15.5) ask them to confirm it in writing...you will then have an extra 28 days.Copy to MCOL Northampton.

Please confirm when the defence needs to be submitted by

 

You request an extension by sending Hagarty a letter or email requesting an extension to file a defence as to CPR 15.5

 

If he agrees, you send a copy of his letter agreeing to an extension to the court

you can go up to 28 days after the date your defence is due by now:

Dear Sir/Madam,

 

I write with regard to the above matter.

 

 

I respectfully request pursuant to CPR Rule 15.5 that you agree to an extension of time until 4pm on , DD MMMM YYYY for me to file and serve my Defence.

 

I trust your client will accept my request,

however should your client refuse then I will apply to the Court,

and this will serve to increase costs in this matter,

which I understand that the parties involved are recommended to avoid.

 

Please let me have your reply by 4pm on , DD MMMM YYYY.

Yes it is fine

 

I myself would remove the paragraph stating "i trust your client"

 

We are trying to appease Hagarty with this request, lets play nice to begin with

 

That's what i would do, but it is your own choice to remove or keep that paragraph

 

Remember

 

You are asking for an extension if it suits you, not Hagarty

I have formallyrequested a Subject Access Report which was confirmed as to be sent by Welcomefinance, this has failed to arrive. However they have sent a copy of anagreement.

 

 

 

The signature shown ismost defiantly not my signature, I ask that copies of all the other agreementsto which have been refereed to are also sent, to be able to provide to thejudge.

 

 

 

I am also in the processof having a report made by a graphologist in regards to this.

 

 

 

I also paid a lumppayment in branch and this cannot be seen.

 

 

I look forward to receivingthe copies of the agreements which hold my signature.

If you are requesting other documents relevant to the claim

 

You make a part 18 request to Hagarty for that information

 

LETS GET THE EXTENSION TO FILE A DEFENCE FIRST BEFORE WE DO ANYTHING ELSE

I'd do the 15.5 request first as postggj says, get that confirmed first, then explore the other options!
