Pleaseanswer the following questions:

1. Upon whatdate was the last payment made on the account?

2. What was thesource, method and amount of the payment?

3. Was aDefault Notice issued pursuant to section 87 of the Consumer Credit Act 1974(as amended) and if so:

a] Upon whatdate, for what amount and what was the date for remedy of the breach?

b] Was theissuance of the Default Notice noted in the communications log?

4. Does theamount claimed include charges, and if so what amount?

5. Copies to beprovided of all credit agreements

6. Any statement of means policydocuments as to any insurance products sold by welcome financial services

7. Any statement of price documents associated with any financial agreementbetween the defendant and the claimant

8. Any insurance underwriting sheetdocument associated with any financial agreement between the defendant andclaimant

 

TAKE NOTICETHAT YOU ARE REQUIRED TO ANSWER THE ABOVE REQUEST

WITHIN 14DAYS OF SERVICE OF THE SAME UPON YOU.

CPR requests should be sent immediately. For those items mentioned in the PoC you would use CPR31.14 - for those items not mentioned in the PoC, you would need to use CPR part 18 but only for information. You CANNOT ask for Documents - you can only ask if they have them in their possession, were they processed as they should have been. Dependant upon their response, you can then ask for sight of the documents.

 

Has the OP acknowledged service ?

 

 

CPR 15.5 would only be used say 7 - 10 days before the Defence is due if it looks as though the opposition is not going to be able to provide the information in time.

Claim acknowledged

No supporting documents received yet from Hagarty

CPR 31.14 has been sent and received by Hagarty 10/06/2013

 

 

 

Issue date 6 June + 5 days for service = 11 June + 14 days to acknowledge = 25 June + 14 days to submit defence = 9th July 2013

 

I was just very puzzled that the OP was being advised to send CPR 15.5 - request for more time on the 10/11 June ??

I am really sorry I am lost I have sent the extension request

 

Do I ask for documents etc at this stage?

 

I am sorry been off for a while my 6 year old broke her arm and we have been in hospital!

No need for an extension request now as to CPR 15.5,:-D you have that receipt

 

lets make Hagarty sweat now and work out your costs :lol:

What interests me as well is that welcome have placed a default on your credit files, and instigated a court claim on an account that was paid off in 2009, that receipt proves it

 

Even worse was you applied recently for a mortgage and were turned down on the information registered with the credit agencies

 

Welcome are in big trouble but let us first get this claim withdrawn

ON THE 24/09/2008, DID ANY MONEY GET TRANSFERRED INTO YOUR BANK ACCOUNT, ASK YOUR BANK FOR A COPY STATEMENT FOR THIS MONTH, IT IS IMPORTANT AND WILL END THIS

 

Do it quick as we only have a few days left, PHONE THEM UP OR GO INTO BRANCH TO REQUEST

I have just had an email to say that they grant an extension to 06.08.2013.

 

also they are saying they haven't had an SAR request so forwarded them a copy of the letter which says they have received it and will send it out.

 

Fingers crossed.

I just want to say a massive thank you for all your help and support it has been a bad few weeks for me, and this has not helped.

 

 

Our daughter 6 broke her arm (climbing to get a book when she was meant to be in bed -kids eyy) and its had to be pinned.

 

 

cars gone wrong, and was panicing,

 

 

I just wanted to say thank you for all your help and advise,

 

 

without it I think I would be rocking in the corner xxx
