That's what I thought, so Active on 24/7.

 

Has there been any correspondence from them under either name?##

You could also use the letter to complain to the authorities.

 

I recieved no letters ect from them, to be honest I don't remember taking out the loan, but I was in such a mess last year I couldn't say I haven't. It was my DMP Step Change that advised me to check my credit file and thats when I found it.

 

I have spoken to the OFT they and advised me to email in a complaint and they will look at it and contact the ICO

 

I contacted the ICO via the telephone and the women I spoke to had never heard of Noddle or Call credit, she did how know Experian and Equifax, I explain the situation to her and she seemed quite confused on how online credit reports worked. She said that she couldn't see how someone could put that on my file and when I request my credit file all the information would come gathered from different files/locations. I asked how does the online system work then as all the information is sitting in front of me on the screen? I don't think she knew after being on hold several times she stated that although it was quite disturbing she didnt she how it was a complaint they could deal with and there was anything they could do?

 

The police have just been back in touch and there going to call Active Securities to see what they have to say and they asked me to advise them what Noddle / Callcredit have to say when they get in touch.

Yet another PDL company hiding behind a redirection centre.

I would if the confidential part was kept, anything to help others to not make the same mistake I did by taking out Pay Day Loans

I've sent the email..

 

Yes spoken to them on the phone, they haven't actually heared of Noddle or Callcredit, but when I explain what they were and what my issue was, she said that she couldn't see how they could deal with it and just advised me to keep everything in writing and to contact the ICO

Wow. This is a brand new and frankly disturbing low. I sincerely hope the Police do take action on this one.

Further Updates:

 

 

Noddle have just phoned me to confirm that they have recieved my complaint and wanted to ensure I have a copy of the offending text before they removed it. They confirmed that everything further would be in writing and the their Client Service team will speak to ActiveSsecurities Ltd and that because I have made the it a formal complaint their complaints team will be in touch, but it will be removed from my file ASAP

 

I also recieved an email from 247 Moneybox about a password reset even though I haven't requested one:

I've been through all of my old emails and bank account statements and I cannot find anything that relates to 247 moneybox, I think they just tried to call me too 0117 325 0161 so I must of applied or had a loan with them at some point as they have my details?

My Complaint Letter:

 

 

Dear Sir or Madam,

This letter is a formal complaint of something that is quite disturbing on my credit file.

I am very distressed that you have allowed Active Securities LTD to place a threat to my life on my credit file. (Screenshot attached)

 

I am also concerned that due to the nature of my complaint I was unable to speak to an advisior without delay, I have requested a call back via your telephone service but as of yet I have not recieved this.

 

I have also reported the comment via your report button, but feel that I cannot wait the quoted 28 days response. (Dispute reference number: ******)

 

I have reported the incident with my Local Police Force Cheshire Police (Log Number ***-22/01/12) due to the serious of the complaint and the fear of the threat danger to mine and my familys life.

 

With the proof I'm attaching to this letter, I'm sure you'll agree it needs to be removed ASAP, I have c.c in the Financial Ombudsman and office of fair trading.

 

Please delete the above information as quickly as possible and please provide an explanation of how the threat was allowed to be posted to my credit file.

I am just following up from our telephone conversation this afternoon. Thanks for your email and for alerting us to this issue on your credit report, I am really sorry again that this is present, I appreciate how worrying and distressing this must be.

 

I realise that I didn’t explain why this information came to be apparent on your Active Securities account. I did try to call you again so I could clarify this l but I was sent straight to answer phone. If I recall you were on your mobile phone with limited signal.

 

The data we display is provided to us directly by the lenders and we act as custodians of this. With this in mind we are displaying the address on your Active Securities account as it was provided to us.

 

As I mentioned on the phone, due to the nature of the issue, our client services team are dealing with this directly and they will be in touch as soon as possible to let you know that the information has been removed.

 

Could you just confirm whether or not that you wish to raise a formal complaint Noddle specifically? Once I know I will be able to forward your complaint to the appropriate department.

 

I am sorry again that this has happened. I look forward to your reply.

Thank you for your email, I do wish my complaint to be passed to your complaints department as a formal complaint.

Whilst I understand that your are custodians of information provided by 3rd partys, as custodians of this and my personal information you are legally required to look after my information in compliance with the Data Protection Act. This means that you must make sure that the information you hold is used fairly, kept secure, remains accurate and is kept up-to-date. I would expect that data of such a personal nature and effect it can have on a person whould be subject to extensive checks before any details are added to my credit file.

 

As I feel that your company has not met the requirements in accordance with the data protection act I wish that my complaint set out in my previous email to be addressed in the hope that assurances can be given that this type of incident cannot be repeated.

Anything I've missed off? She did say on the phone that this is a first for them, so it may take some time to investigate..

Going to do the other CRA's via snail mail and £1 payment. I've not thought about the complaint to Active yet, so any help would be great as all I've got at the moment is "why did you say this?"

Didn't see this yesterday but I c.c the Financial Ombudsman Service into my complaint to Noddle and I got an automated reply, the emails quite long but from the section below it says I have to wait 8 weeks until I can pass my complaint to them is this right?

 

 

Businesses normally have to complete an investigation of a complaint within eight weeks. If you are unhappy with the outcome of their investigation (or more than eight weeks have passed since you first complained) you can ask us to look into the complaint

When something as bad as this happens the complaints procedures of the offending company must be exhausted before going to FOS the time scale is 56 days.

I have nearly finished the letter and will post it up later this morning.

Ok Here's the Formal Complaint, you need to send a copy of the cra entry with this, and use recorded delivery.

FORMAL COMPLAINT: Misuse of Credit Reference Files, Threatening Behaviour.

 

Dear Mr. Grantham,

 

I have hade cause to check my credit reference files recently and have discovered that Active Securities Have placed an entry on my credit file held by Noddle (CallCredit) in regard to my account with xxxxxxxxx payday loans, I find that the entry carries the following statement from your company ''Mr.xxxxxxxxx is a dead man we are comming to get you''!!.

 

As you must be aware such a threat has caused me a great deal of anxiety and distress and brings the fitness of your organisation to hold a Consumer Credit Licence into grave doubt.

 

One fails to understand the mentality of the person or persons who made this threat and placed it on my credit file, and I now DEMAND this entry and any other entries made on credit refence files in the UK are removed immediately, and you WILL confirm in writting that you have complied.

For your information this matter has been reported to the police Log number xxxxxx and report/complaints are being made to the OFT and the ICO forthwith.

 

I believe that Active Securities Ltd should make an offer of substantial financial redress for it's unprofession and threatening conduct which I believe would be to write off any liability to Aktiv Securities Ltd and make a minimum payment of £750.00 in redress for the stress, time and trouble this unbelievable conduct has caused.

 

Should you reject this or deny responsibility for the conduct of your company, the next communication WILL be a formal letter before action.

 

I trust you as Company Seretary will take immediate action regarding this outrageous conduct and not rely on the usual 56 day time span for a formal complaint in my estimation no more than 7 working days from the date of this letter is more than reasonable.

Noddle customer services have also esculated my complaint to their complaints department and have offered to suppress the account so it cannot be seen by others until its dealt with / removed. Do you think I have a case for redress with Noddle for allowing the upload of the comment onto my file?..

Hi Mawey, It might be so, I don't know if they woud be aware of the abuse of the system AS Ltd are ultimately responsible for the data posted.

I'll check the question of liability.

 

Get the complaint off to active imo there's more likelyhood of redress.

What a truly terrible, scenario. Looks like this account is in default, but this is not acceptable. Payday Loan Companies are not popular right now, under scrutiny for their general practices.

 

As has been mentioned the information provided by Noddle is taken from the specific lender in question, so Active Securities Ltd/247 Moneybox need to update this, Noddle can remove this part of the entry, and keep the other details.

 

Noddle is provided by Callcredit (Credit Reference Agency), but my concern is that is also shown on your credit file data with Equifax and Experian. Unfortunately I would suggest contacting all the credit reference agencies, requesting this entry be removed/updated , so the credit reference agencies contact the lender in this case, on your behalf.

 

There maybe delays, with the CRA's so also suggest writing to the lender in question which looks like Active Securities Ltd (who own 247 Moneybox), to ask for this to be removed immediately, providing the picture if necessary. Looks like a letter template has already been provided.

 

I would contact the lender in question immediately in writing to info(AT)activesecurities.com and support(AT)247moneybox.com.

Just recieved this email from Noddle and I'm slightly confused, I may just be reading it wrong.

 

Have they hidden the information as of now or will it be hidden in 30 days? I can still see it when I log in..

As your Noddle report updates every 30days you won’t see this action reflected there until after the next refresh takes place.

 

Your complaint has now been referred to our Customer Relations team so, should you have any further questions or concerns, they’ll be able to help you. I’ve copied them into this email for reference and to make sure you have their contact details.
