Hi,

Iv been reading through the forum everyday - its quite addictive actually! Am i right in thinking that you can claim back charges from hire purchase agreements i.e. catalogues cos if this is the case they owe me loads!!!

 

I have had several catalogues - all of which have now been transferred to debt collectors (Metropollitan collection services & Morecroft if any one knows of them) and the main reason i can't pay them back is because of all the late/ missing payment charges they have added to my account.

 

My HSBC account is also being dealt with by Met collection services & i owe aprox £1,650 from my student overdraft and £500 for my student credit card. Again due to excessve charges. Finally there is my Capital one card where i have paid loads of charges.

 

Should i claim back the lot. I have already sent a DPA off to Halifax (my current account) - should i see how it goes with that one first?

I would go for the lot, I agree deal with you do the halifax first, it will give you some experiance and understanding of how it all works and what to expect.

 

However if some of your debts are with collection agencies, I think you should get in touch with these to let them know what you intend to do, it may keep them off your back for a while, unless of course you have an agreement and your able to meet it.

 

Don't worry about giving them a heads up on your intentions, there is nothing they can do about it.

No i don't have an agreement with them - i'v hardly paid them a penny! I am up to my neck in debt and this is the only way i can see a way out of it.

I had an account with Choice catalogue and I paid £200 every month without fail. Last year, I miscalculated when a buy now pay later payment was due and they asked for £800 as that months payment. I phoned them and told them I couldn't pay that much in one month and continued to pay the £200 every month.

 

Anyway, they passed my account to NDR. I refused to acknowledge NDR and did not sign an agreement with them. Because I wouldn't sign an agreement and continued making my payments to Choice, NDR charged me £12 month. I found out that NDR is just another office/part of Choice catalogue. They also stopped paying my commission, which was £20 month. I complained but received a letter from them basically saying tough, that all this is in the small print of the agreement with them, and that I could complain but as they didn't join the Financial Ombudsman Service until after this dispute, that it would be a waste of time.

 

I think Choice are ripping of their customers so that they can make more profits. There was no need to pass the debt on to NDR as I was making regular payments. They also put on my credit file that I was in arrears, not for the one payment, but for every month after that. I have paid the account off in full and then they had the cheek to ask me why I wanted to close it!

 

Does anyone have any ideas how I can get the charges and commission back and is there anything I can do to correct their credit file entries on me?
