  1. The banks have admitted today that they have been fiddling the interest rates on mortgages since 2005. Therefore, if you are paying interest on your mortgage each month you are entitled to sue the mortgage lender and claim damages.   5. I was forced to sell my house due to charges and ridiculous interest rates being charged by Bear Stearns. That was in 2001 and I would like to bring a case against them and recover the money, however I don't know if I can do this because of the 6 year rule. Also, I don't live in the UK any more and would need a solicitor to take action on my behalf. So if it is possible to make a claim can anyone recommend a good solicitor.
  6. I had an account with Choice catalogue and I paid £200 every month without fail. Last year, I miscalculated when a buy now pay later payment was due and they asked for £800 as that months payment. I phoned them and told them I couldn't pay that much in one month and continued to pay the £200 every month. Anyway, they passed my account to NDR. I refused to acknowledge NDR and did not sign an agreement with them. Because I wouldn't sign an agreement and continued making my payments to Choice, NDR charged me £12 month. I found out that NDR is just another office/part of Choice catalogue. They also stopped paying my commission, which was £20 month. I complained but received a letter from them basically saying tough, that all this is in the small print of the agreement with them, and that I could complain but as they didn't join the Financial Ombudsman Service until after this dispute, that it would be a waste of time. I think Choice are ripping of their customers so that they can make more profits. There was no need to pass the debt on to NDR as I was making regular payments. They also put on my credit file that I was in arrears, not for the one payment, but for every month after that. I have paid the account off in full and then they had the cheek to ask me why I wanted to close it! Does anyone have any ideas how I can get the charges and commission back and is there anything I can do to correct their credit file entries on me?
  7. Hi, I haven't received any money back, but I haven't heard from them since! Think these debt collection agencies are a law upon themselves and maybe we should be campaigning to get something done about them.

These people telephoned my son on Friday, they were threatening and abusive to him so he asked me to continue the conversation, thinking that they would be more civil speaking to an older person. Anyway, a 'Mr White' began hurling abusive comments to me about my son and then started being verbally abusive to me. This Mr. White told me they were registered agency, so I asked him for their Credit Licence Number, he refused to give it to me. I then asked him for a Deed of Assignment, he said they had no legal obligation to supply one, I then asked for a statement to show how they arrived at the sum they are demanding, he refused to supply one. He said he was starting legal action against my son immediately. I told him we had moved house and asked him to take my new address, he refused. So any papers they serve will be deliberately delivered to the wrong address. So, I've reported them to the Financial Ombudsman, the Information Commissioner for offences under the Data Protection Act and to Kilmarnock Trading Standards.   9. No, there is nothing on my credit file relating to this debt with RBS. I've got my diaries from years ago and all my account numbers are in them and I know I've given them the right details. I contacted my old branch in the first instance. Just think they are using 'tactics'.
  10. Hi, Don't know if anyone can help, RBS closed my account in 1999. I sent a Data Protection Letter with my account numbers but they have written back stating they have no record of the account. I intended to apply to have the statute of limitations overturned to claim back the charges, but if they are saying they have no record of the account I don't know where to go from here. To further complicate things, they passed the (overdraft) debt on to a company called BTMK. They reduced the amount originally demanded and I was paying them £50 month for years (repaid £1,118.91 in total). Anyway stopped paying them in April when this OFT announcement came out. BTMK started sending the nasty letters and I wrote asking for the deed of assignment, (11th August 2006). They wrote to me stating they had wrote off the remaining £500 which they said was outstanding and my case was now closed. They returned my £1 postal order. They then phoned me and said that I acknowledged the debt by agreeing to repay the reduced amount and if I pursued the matter they would make me repay the £500 they have written off. I have still not received the deed of assignment and want to know if I can take action to recover the £1,118.91 I have paid to them. Also I want to know if I can use BTMK to get RBS to acknowledge the existance of my account. Would really appreciate any advice on this one.

  12. Was wondering if anyone has come across this one. Followed your procedures up to sending the DPA letter and £10. RBS have replied that they have no record of my two accounts (which were closed in 1999 but I'm applying to have the Limitations Act set aside). I sent them the account numbers and branch details. They passed my overdraft on to their debt collecting agency and when I requested a deed of assignment from them they failed to produce it. Really don't know where to go from here, if the RBS say they have no record of me what can I do? Any suggestions would be appreciated.
  13. Royal Bank of Scotland have sent me a letter stating that they can't trace my accounts with them (closed a few years ago). I have supplied the account numbers, but where do I go from here? Would appreciate any advice Thanks

They sent a letter yesterday stating 'they are no longer taking action in this matter and their files have now been closed'. They then tell me to contact the RBS direct to arrange repayment of this debt. They returned the postal order but not the documents I requested. I have paid BTMK £1,181 since 14th May 2004. Originally they told me they purchased the debt from RBS on 17/10/2002 Today I received a Formal Demand for Payment from Robinson Way & Co for the £500 outstanding. I did telephone these people last week and told them this was subject to legal dispute and they couldn't contact me or it would be classed as harassment. Looks like BTMK don't have the deed of assignment, so can I sue them for the money I've already paid to them. If so, is there a template letter? Also, what should I do about Robinson Way? Thanks
