Daughter injured by car and left. What do we do now?

I'm not sure that she has been cautioned - there's a difference between being interviewed under caution and receiving a police caution. Unless she explicitly stated to you that the driver had been cautioned for an offence, I would just read it as she'd been interviewed under caution.

my husband said he thinks it's interviewed under caution and driving without due care and attention. I'm making a check list of questions to ask the police and keeping a diary of my daughter's conditon.

 

Yes, but was she did she actually receive a caution for driving without due care and attention?

 

What I mean is, if the Police interview if you're suspected of a criminal offence they will do so 'under caution' (the old 'anything you say may be used against you in a court of law' bit), then following this, if they decide you have committed an offence will charge you with said offence and may offer you a Police Caution - in order for this to happen, you would have to admit the offence. It's basically a formal alternative to prosecution - you see it used most frequently for things like first offence shoplifting.

 

Sorry if I'm being thick and teaching you to suck eggs - it's just still not clear to me which 'caution' she's had.

The police have just left the driver is being charged with leaving the scene of an accident and driving without due care and attention, the driver has admitted to what she has done and the police are now waiting to see if it will be taken further by CPS. The £60 has been given back to the driver and my daughter did say it would have been better to have a letter with some sort of apology rather than the money as it seemed really cold. The police are now going back to the driver to relay my daughter's wishes. The police officer said it was her fault about the money she just thought it would be a nice gesture to replace my daughter's insulin pen injections and meter.

Well what you do now is up to you in regards to the officer getting involved in this 'offer' which I still maintain was completely inappropriate and possibly illegal. You may wish to take legal advice on this.

 

But the main thing is to put an injury claim in against the driver which should now be pretty straight forward now she has been charged. While she may get the driving without due car and attention dropped, I doubt is she will for the failing to stop. I suggest using the link I provided earlier or use one of the more reputable injury claims specialist which give you 100% of what compensation they recover.

TBH I can't see the CPS not taking it further under the circumstances. What a stupid inconsiderate woman.

Right, now everything makes a bit more sense to me. I agree that just handing her the £60 made it seem like a cold gesture. the police have handled this very clumsily as far as I can see.
