Good Evening, just filed my MCOL total claim now at £3601.36, my god hope it really is as simple as this to get it all back. I had to wait for my parachute account to be opened - Abbey and HSBC said no - Natwest were fab, even opened a savings account for me!! Hopefully I will get my money back, pay off my overdraft, save a bit and have a fab xmas with the kids., god we need it, had a s..t year so I'm hoping for a bit of good luck!! When should I start looking in my account for MY money?

My husband is now telling me I am checking my account balance "too often".

He won't be saying that when he opens his christmas present!

Am I the only one who gets nervous over this? I still get freaked that it has all been too simple, that I've f***ed up somewhere and they are going to hang me out to dry?

lol Emma you tickle me pink, there is something about your posts that have me lol (ing) literally!

You deffo aren't alone with the nerves, this is my second claim, but I still have waves of nausea. Thing is though, last time, I got a refund, I had this day of elation then I realised I missed the thrill of the chase, Ya know, a bit like when christmas is finally over and everyone has gone back to work! lol

Well, christmas has definately arrived!

2 credits to my account, and okay the majority has taken 12 hours to clear properly, but its there now.

Thank you, thankyou, thank you- to all who run, help, and have got me through this!

Oh, I'm getting a bit "oscar acceptance speech" about this- but thanks to this windfall we can fund a decent present-fest for our small dictator, sorry- wonderful child.

Right I'm off to woolworths- there is a fisherprice zoo set with Michael's name on it.

HELP!!! I have a couple os questions....

 

I'm doing my money claim now. How do I include the charge that hasn't been charged yet??

 

Also, how do I work out the daily rate? I know I've read this somewhere but can't find it and I really want to get MCOL done asap.

Another quick question (soz for being a pain!) On the spreadsheet, what date should I use for this new unpaid DD charge, because they haven't even told me about it yet, I just know that I missed a DD a couple of days ago??

Hiya Kirsty

You cant add charges that haven't actually gone out of your account yet, all you can do with these, is ask Nationwide nicely for them back..........chances are you will get them after you have already successfully got a refund, I know I did with Halifax.

You work out your daily rate by taking your figure and timesing it by 0.0002

Thanks dollies. I now have an even bigger problem. I can't use MCOL because they don't appear to accept visa electron which is the only card I have. I thought they took all debit cards but obviously not. I'm now struggling with the N1 hard copy!! I have no idea what to put under 'brief description of claim' also it doesn't actually have a space to put my address but at the end it asks for a correspondence address if different to overleaf, OVERLEAF WHERE???

 

Can anyone help....pleeeeaaaase!!

I haven't done a N1 form before, as I borrowed my friend card, I only have Electron too!

I have just found this though

PARTICULARS OF CLAIM

 

 

1. The Claimant [has] [had] an account 1 ("the Account") with the Defendant which was opened on or around 2 [and closed on or around 2 ]

 

2. During the period in which the Account [has been] [was] operating the Defendant debited numerous charges to the Account in respect of purported breaches of contract on the part of the Claimant and also charged interest on the charges once applied. The Claimant understands that the Defendant contends that the charges were debited in accordance with the terms of the contract between itself and the Claimant.

 

3. A list of the charges applied is attached to these particulars of claim.

 

4. The Claimant contends that:

 

a) The charges debited to the Account are punitive in nature; are not a genuine pre-estimate of cost incurred by the Defendant; exceed any alleged actual loss to the Defendant in respect of any breaches of contract on the part of the Claimant; and are not intended to represent or related to any alleged actual loss, but instead unduly enrich the Defendant which exercises the contractual term in respect of such charges with a view to profit.

 

b) The contractual provision that permits the Defendant to levy such charges is unenforceable by virtue of the Unfair Contract Terms in Consumer Contracts Regulations (1999), the Unfair Contract Terms Act 1977 and the common law.

 

5. Accordingly the Claimant claims:

 

a) the return of the amounts debited in respect of charges in the sum of £ 3 and any interest charged thereon;

 

 

b) Court costs;

 

c) Interest pursuant to section 69 County Courts Act as set out on the attached list of charges or at such rate and for such periods as the court deems just.

Thanks but I already have that. I can't find info anywhere on how to fill in the rest of the stupid form, it's different to MCOL. Also, what on earth do I do with it now? I can't post it with a cheque cos I don't have a cheque book, they won't take my card and I work 9 til 5 so can't take it into the court with cash!!

Yea sorry, as soon as I posted I realised it wasnt what you wanted, and am frantically searching the forums to find the answers!

I have worked out that you can send the printed form with a postal order to the court.

or if you can find someone that will let you use their card you could still use mcol, they take every other card but Electron, which if your luck is anything like mine .........typical!

Let me know how you are doing, and if you still need help I will search again tomorrow for you, cos I don't do the work thing! lol

I didn't used to do the work thing but that evil thing called money (or lack of it) soon put a stop to that!!

 

I will ask my mum tomorrow if I can use her card as I would rather use MCOL. Failing that, I will send a postal order.

 

I can't thank you enough for all you 'frantic searching' on my behalf and all your advice. I'm wondering if we are the only 2 crazy people on CAG at narly midnight LOL!!

Sorry- I don't get near the computer until 1am... and I did my mcol at this time- so errm.

If you can use mcol I know it seems preferable. If you need anything... I try to get near the computer for at least a moment in daylight hours.

I did do the work thing, then got pregnant, did it again then got pregnant, did it again and got pregnant. Went back to work, youngest got to nine years old and life was settled then .....................I got pregnant!

Little girl after seventeen years of producing boys!

I decided that was it until she was old enough to fend for herself, mainly cos I don't wanna miss a thing, but also worried that history will repeat itself......... I'm too old for all that kinda thing !

Sounds like you have a busy life!! Mine's busy enough and I only have 2 girls.

Hi, my mcol has been acknowledge, so im waiting the infamous Mr Bacon to send me a letter stating that they are going to defend. Hope that they dont decide to make an example of ME!!! My hubbie says that it cant be this easy but he hopes it is as he hasnt seen me for three weeks cos ive been on this site every evening.

 

Hopefully if all goes to plan i will have my money back before xmas, cant wait, good luck to everyone, its seems D Day is looming for everyone!!!;)
