I'm having same problem with nationwide. (CFO cleared my bank account £1170 21/07/2012)The 1st lady hung up on me when I started referring to FSA. The second lady still insisted they don't have to do a chargeback and it's pending investigation but she filed a complaint. Any advice on how to deal with bank

CFO have cleared my Nat West bank account this morning even though I have been on a DMP with them since july 2011. I have no idea how they got my bank details as I have only had this account for 3 months. I have been onto the bank and cancelled my card I have spoken to CFO and they have told me my account is paid in full but I still do no trust them. will never use pay day loans again

Bloody hell, if they are getting info in this way, surely its illegal, and very much fraud?

 

I think Showergirl should contact the bank and see what card details were used to empty her account - if its the new one, then I would think the Fraud line at the bank is the way to go, not chargeback!

I am so depressed at the moment but will see if I can borrow some money off my daughter to help me through this month.I was slowly getting myself out of debt so I could start to pay extra to my dmp and get rid of these bloody loans altogether. Let this be a warning that these companies can get your card details .

I've got what I would call half a result .. Nationwide have agreed to credit my account with the £1170 from there own funds. But they are gonna continue to investigate and reserve the right to take the money back if it's proved CFO acted legally..

Hi Bradders 73, Would it be poss. for you to tell me what you wrote to get Nationwide to refund you? I am in the same predicament (just less money-around £254.60 in total)- I had repaid CFO at the end of May, then they fleeced my account of my child benefit plus more. Nationwide even let them go overdrawn on my account-something they have never let me do in the 2 years I have banked with them.

I have phoned=stalemate, I actually stayed on the phone 45 minutes refusing to go without a refund - all it left me was another £18 out of pocket with the phone bill. I've sent so many secure messages-but they have just ignored them. I sent copies of the FSA guidelines etc-all ignored. I went into local branch-they just got me to complete a visa dispute form and said it would need to be investigated. Although they did get me to speak to their Fraud dept. on the phone-but they didn't want to know as I had had previous dealings with the company (although I told them I had repaid the loan in May and had not given my card details - this was a new card issued in June).

Thank you for any help you can give as I am desperate to get my money back-I could not pay my rent last week and at this rate won't be paying next week's either, or eating!

I didn't actually say anything I kicked up a bit of a fuss quoted the FSA and OFT but they still weren't interested... I really think they don't know about charge back one lady even said u can't do it with a visa. I said what u can't do a visa charge back with a visa. Anyway she filed a complaint for me and that was it. Then I got an email saying they had credited my account pending investigation but will take it back if CFO come back with relevant documents

You need to speak with the disputes team. Not the min wage front line call centre reps.

Hi Bradders,

 

I appreciate I'm not that experienced, but when I had problems with CFO and Barclays I tried the nicely does it approach, when that failed I called the Head Office Customer Relations team and within 10 minutes the problem was sorted. As R Imp stated above, dont go to the front line imps! Aim High!

 

There's a letter in my post "CFO emptied my account too!" that I sent and emailed, which appears to have made a difference.

Hello Im in the same position with Natwest. I have had £1170 taken without my consent Friday 10th August in 9 different transactions similar to OP.

I have complained to Natwest who keep passing me across to the Visa dispute team who then tell me that because I owe the company money there is nothing they can do.

Please could someone tell me if this is true or not ? Also could Calfdwich tell me who he spoke to in order to get his money back.

It is NOT true, the company have broken their contract with you by taking more than they were entitled to.

 

Tell Nastywest that you are now getting a crime number from your local police force and that their action is being reported to the ombudsman service and the OFT, who are already aware of this company.

 

Get onto the OFT - http://www.oft.gov.uk and Trading Standards http://www.tradingstandards.gov.uk and to MP Stella Creasy who is very active in this field, you will need to google her details. She has journalists ready to name and shame these companies who take the law into their own hands.

 

I won't be able to help any further on this thread as I have other matters to deal with.

Hello! I spoke to the dispute team and was getting the same story as you, but I stood my ground, and from the links others were posting in this thread for me, I was pointing out that Natwest is breaching various FSA etc rules by not refunding, and she caved in finally after a word with a supervisor.

 

Stay polite, but make it clear you have researched this, quote FSA etc guidelines and stay firm. I also pointed out that they were treating me unfairly under the BCOB legislation that is also linked in this thread.

 

I also pointed out that taking 4 or 5 transactions at 2am on a friday night is pretty clearly NOT standard behaviour, and thus is additional proof I did not authorise the transactions.

My saga continues

- looks like I will be putting a complaint into the FSO.

 

After a month of stalemate and their fraud team investigating

-even though I completed and asked for a visa dispute to go ahead, not fraud,

 

I finally spoke to a member of the fraud team last Thursday who said they had handled it by mistake therefore no visa dispute investigation had been actioned.

 

he then said he would pass the file to visa disputes for them to deal with and he didn't know if they would refund immediately or have to wait until after they had investigated.

 

Got a letter on Saturday from nationwide visa disputes saying "they had looked through the documentation and unable to initiate a dispute as the transactions appear to be valid".

 

Fuming I rang them this morning, armed with FSA/OFT etc guidelines, spoke to 3 people.

One of them from complaints (I asked him specif. if he was customer relations-he said yes).

He said their final answer is no dispute and happy to stand by their decision when I complain to the FSO.

 

Their "evidence" (which they are sending to me) is an online contract "proving" I owe them money/took out a loan.

 

My arguement to him was I did not approve those specific transactions to that company on that specific date as per FSA/OFT guidelines

- he was adamant that this did not matter-they have a loan agreement and that is their final answer.

 

They are putting it in writing so I can go to the FSO with my complaint and all their incompetencies.

 

Am I in the right still to pursue the visa dispute with the FSO?

Yes. it is not up to the bank how your money is spent.

 

Regardless of if you owe money or not, if the transaction was not authorised or agreed to then it must be refunded. what your bank has basically said is any creditor can take as much money from Your account as many times as they like without repercussion.

The bank is totally wrong in refusing to stop/charge back in these circumstances.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

that is what I understood and that's why I will fight until they refund me

- I did try staying on the phone and speaking to different people but in the end when he kept repeating that's their final decision

I had to stop the conversation and will take the next step now they have actually said they will put their reasons for refusal in writing.

 

Nationwide have been an absolute nightmare and more than useless in helping me,

 

they are more interested in allowing companies like this to bully people like me.

 

That money means a lot to me and has put my family under extreme financial pressure and I will not them win!

Hi all . I am in the same situation. Over the bank hol I have had over £500 taken from my bank account from CFO when I already have a debt plan set up and agreed with the CCCS and them. The bank have told me I have to speak to the company to get it back but I know they wont simply refund and it is my rent and council tax money they have taken. Can anyone suggest what action I should take as I have tried to email CFO this morning and had no reponse yet and need the money back urgently to avoid being evicted or in rent arreas. I have proof they have accepted my debt plan payments over the last 3 months. thanks Emma
