WELL!!!! we just got back from court! Our house has been SAVED!!!!! This is our last chance. There was a duty solicitor in fact he was from the same office that I used as an immigration solicitor!!! His main focus was that we were coerced into an unrealistic repayment amount in the past hearings £250 and £241 per month. He even stated the current offer of £175 was too much.... he quoted the Norgan ruling and said using those figures £48 per month was reasonable. Well in front of the judge... the solicitor from Santander quoted that because we couldnt keep up with previous amounts that they wanted the house.... the judge agreed with the duty solicitor and she ordered monthly payment plus £80 per month.... :) She also took into account the tax money and encouraged us to use it but said she couldnt order us to because there was no set date for it to arrive and stressed to us ... this is the last time.... believe me... I feel this is VERY do able now!!!!! so instead of £1,100 a month we now have to pay just over £900. THANK YOU ELL-Enn you are a star!!!!!!!!!!!

Brilliant news jil - I have said it before, and I will say it again. Judges are MUCH nicer people than mortgage lenders, and far more reasonable.

 

With Ell-en's help and a sensible plan they will try and help you, whereas lenders just want to push and push until you break.

Just a little update...... we still have our home but yesterday was the original eviction date.... it seems communication broke down between the bank... Santander/HL interactive and the courts.... the locksmiths showed up at the door to change the locks... I ran out and said that we had been to court and the judge ruled in our favor but we had nothing from the court to say that... nothing had arrived in post yet :( so a tense half hour and being late for work... but all worked out in the end. Everyone had to make phone calls and all but that was stressfull.... thinking all was ok... what if I had gone to work??? would they have come in and changed everything???? Well the baliff never showed so they would have called them... but as far as the bank knew they were still getting the house.... well.... in the end we are still here but maybe the moral to the story is... make sure you get something from the court before the intended eviction just to be sure!

That's outrageous ! You need to make a formal complaint about this to Santander and HL interactive - if you need help drafting a letter please let me know. I remember this happened to another Cagger a couple of years ago and she created a right old stink with the lender - I believe she got a compensation payment for the stress.............. I'll see if I can find the thread

Ohhh I would love to... they just feel they can walk all over people like us..... they need to be brought down a few pegs....
