Hi, what date is the eviction?

 

You can apply to the court on a N244 form asking for the eviction to be stopped - you will need to explain why you missed the payment and show how you intendto maintain payments going forward.

 

Do you have proof of all the payments you have made since the suspended possession order ?

yes Ell-en we paid cash and have all the reciepts, the date is June 26th, and I dont know if you remember us speaking before??? We decided against the loan and I am not sure how to word an offer of repayment. We are awaiting some big chunks of money and plan to pay off the arrears but exactly when the checks come we dont know.... they are back taxes from HMRC and they total over 10K and a 4,500 inheritance also....

You need to get some documentary evidence of the tax rebate and inheritance money and also start chasing these to find out when they will be paid.

owe totally in arrears including the last 2 payments~ 7,500 (slightly less) so this will more than cover... we can have the 4,500 before a court date is set so... what we wondered is if we pay all of that towards the arrears in hopes that a judge favors for us or do we hold it back until we know we wont need money to find another place to live?

yes, the renewed income,

will a letter from the accountant suffice for the tax rebates? We can send a copy of all his accounts as done by the accountant if need be but I dont want them knowing too much!!! but.... if it means keeping our house!!!

OK, I can help you with the N244 application. First step is to fill out a budget sheet so the judge can see how you will pay the mortgage going forward - I have affixed one to this post (it calculates automatically as you fill it in).

What about the inheritance money - any evidence of this ?

His father is the benificiary and his father is giving the money to him. If it comes to the court date and all hasn't been done and dusted we will ask him for the money. So we will have that by then regardless. :)
