your not on your own, my claim was served on 7th april for over 3 grand,i've got a hundred and one things going on at the moment so i haven't got round to getting on here much,just spotted your thread tonight.

 

All i've had is the usual 'sorry your unhappy' speil other than the last letter that was as unfriendly as a letter from a bank can get i think, but no acknowedgement of the legal procedings and it arrived after the deadline had passed ???

 

Its strange that they've made you an offer as they certainly havn't made me one (obviously if and when they do i'll knock it back unless its for the full amount) they seem to be treating each case differently,maybe to try different approaches to test the water???who knows

 

like yourself i've got no intention of bottling it now so good luck and i'll keep you posted

Thanks kindly for your reply, it's very interesting to note the different approaches the RBS is taking. As mentioned, maybe they are testing the water, or maybe they've lost the plot and are winging it by the saddle of their pants?

 

Mick, if the deadline for them to acknowledge service or file a defence for your claim has passed, you can go to mcol and request a judgement? I'm a bit lost as to what stage you're at, gimme your sitrep or link to your thread, I'm eager to follow it.

 

vix2000, it's strange that they've called in the OD. Are the values similar or are the charges greater than the OD? I too had an OD and debt with RBS but it's defaulted and been in collection for quite some time now so I don't think there's much they can do for my part. The thing that narks me now is the amount I'm reclaiming is bigger than my combines OD and CC default amounts :(

Well Candice, those bastards have put in a defence for my £532 claim only days before the expiry. Damn them to hell! Can you believe it. Not sure whether they are hoping that I won't bother paying the extra £100 for the questionaire and will cancel the claim???

 

So looks like I'm almost where you are.

 

When are you set to go to court then?

RBS Uxbridge - Claim £317: acknowledged 20.04.06 settled in full out of court 28.4.06

RBS Kensington - Claim £532: acknowledged 24.04.06 settled in full out of court 11.05.06

Not quite matey, I'm a bit further ahead. What'll happen now is that the MCOL will close the claim and it will be transferred to your local court who will send you the allocation questionnaire and additional fee (which I found out gets added to the grand total automagically).

 

Soon you should receive a response from RBS with a copy of their defence and a Civil Procedure Rules Part 18 Request for Further Information. So far these all seem quite standardised so you can find a reply on here (I'll help you if you can't but don't know where it is off the top of my head). Until the claim is allocated to the Small Claims Track (where CPR Part 23 doesn't really allow requests for further information from the defendant), it's technically a normal claim so you should probably reply to it or it might not go well in your favour. Of course you could reply and tell them to stuff it up their jacksy because you anticipate it will be allocated to the STC, so it's your call.

 

You should follow the NatWest threads as RBS and NatWest are the same company and their Group Litigation department deals with both, so most the replies are standardised.

 

Hope that helps, and don't give up yet!! You know you can apply to the court for a fee remission of up to 100% which means they will process your allocation questionnaire for free, but you have to be on benefits or be able to prove that paying part of or the whole fee would put you in financial hardship. Search the HM Courts Service website for form EX160A.

Same here. To date I've not received any acknowledgement of the summons. Today however, I received a letter stating that they would like me to make an appointment to review my overdraft facility. I've had one for about 7 or 8 years and this is the first time I've had to have a review of it.

 

Me thinks their up to something.

 

This is probably quite unrelated. Its our job to ask (tell?) customers with overdrafts to come in to have it reviewed, as we can hopefully sign you up to a loan with insurance - generating more profit for the bank and more sales points for us. (yes folks this is how it works!)

Assuming the letter was from the branch this is definitely what it would be for.

If it was from another department then maybe they are up to something else like you say.

(Yes I work for a bank but am here to help! Please be nice to me! :))

my daughters claim is for more than her od. Is the questionaire requested after the claim is filed? we filed it on monday.

They obviously don't really know what they are doing.... received a cheque yesterday from RBS. Full settlement on the day they also put in a defence? Losers!

Candice, have you had any luck with this one? I have received a very similar defence and a CPR 18, request, i am responding back with no it will probably go onto the small claims and not required, blah blah. Just wondering how you got on... Thanks

Candice, victor!

 

RBS sent me 2 bankers drafts totalling some 28 hundred squid as an out of court settlement with no strict conditions. No admission of liability, they just said it wasn't commercially viable to fight a claim that small.

 

The accounts of the drafts are "Managers Suspense Account" and "Credit Management Services - Sundry Payments Account". I think I have 2 because my 3 accounts were split amongst my branch and the CMS department.

 

Well no court case which I admit I was looking forward to but meh, oh well. One down, another 27 left. *Sigh*

I've been following your thread with interest and have picked up some great advice. I issued my court claim yesterday for over £4k. :)

24/04/06 - Capital One - £170.00 - Court Claim Acknowledged - Defendant intends to defend claim

18/05/06 - Full settlement received (£170.00) + another £20 for charges added after claim issued.

 

16/05/06 - RBS - Court Claim Submitted - Total £4900 (inc. Interest + Court Fee + Allocation Fee)

22/05/06 - Acknowledged by RBS

16/06/06 - RBS Defence Received

29/06/06 - Settlement offer from Cobbetts LPP £2,500

22/07/06 - Hearing date given as 27th October, York County Court

25/07/09 - Cheque received from Cobbets for £4800!! only £100 to go!!

I'm just about to my court bit.

Do you need to enclose anything with the form? i've the list of charges including the 8%, do i need to send any proof of my case or is that self evident with case particulars?

Following the guide and using the template here, I have noted this text:

 

a) the return of the amounts debited in respect of charges in the sum of £ 3 and any interest charged thereon;

 

Why is the 3 highlighted and what does it mean? Am I supposed to change it? There are no notes to accompany it.
