Just taking my first steps towards getting my money back and sorted my SAR letter ready to post, kinda got a knot in my stomach though

Don't panic you are going to get your money back just take your time and check and recheck everything you send and do. Follow the correct time frames and you'll be fine. Keep positive you are entitled to get this money back. Make sure you send a breakdown of charges with your first letter asking for refund as the bank will only try to waste further time by asking for one if you forget to put it in, even though they know full well what they have charges you! Keep your thread updated you will get lots of help and support here.

17th august 06-claimed back 725.00 from HSBC in full (personal account)

28th august -just added up over 19,000 in business charges with husbands HSBC account! ABOUT TO START PROCESS OF RECLAIMING MONIES.

I was nervous to start with. Now I am mad as hell that these bloodsuckers are mesing about to delay paying out as much as they can. Bring it on. I want to see them in Court

Well I recieved my reply from Peter Townsend this morning (my letter 2/10 - his 4/10 that was fast!) blah blah we will supply your statements in the next few weeks blah blah as the bank is providing the copies on a compliamentary basis your payment is returned. Although they have said that some statement information for the period prior to and possibly during 1999 to 2000 is manually stored on microfiche and does not fall within the data subject provisions of the DPA -is that right?

 

thus the journey of a thousand miles has begun ;)

I got exactly the same letter from the same person this morning too!!. I think its just a standard letter to fob you off, I wouldn't worry. I Read another thread today about someone getting same letter, and then recieved all her statements four days later, so shouldn't be long!!

Well I was shocked that my statements hit the doormat this morning! I have double checked and between the 2 accounts I hold (current and savings) there is nearly £2000 in charges. Do I need to deal with each account seperately or can I do it as one claim?

Either.

 

If you put them together, you'll have to work a bit harder to keep things clear at each stage. And when you get to the court claim stage you might not be able to fit all the details on the online form - but you can use the paper version from your local county court.

I am using Vampiresses simple spreadsheet no 2 (reccomended if no balance detail) and it has an interest rate on there of 18.20% - is that right??? its bringing up a heck of a lot of interest on my charges

from what I understand you dont add any interest unless it goes to court then you add 8% to your spreadsheet

yes you can- i already done this for my hsbc account at 14.8% and received it in full. you choose between claiming the contractual rate or statutory 8% at court. thanks for replying anyway

it turns out that barclays contractual rate is only 9.9% so its not much more. good luck with your claims. x

Contractual interest is COMPOUND - but the CCA 8% is SIMPLE interest - and that's a big difference.

Well I have had a response this morning from Barclays, here's what they've said

 

Thankyou for your letter recieved at this office 11 October. I am sorry you are unhappy with the charges you have incurred and one of my team will contact you as soon as possible. May I take this opportunity to explain that whilst we endevour to respond to you within the timescale outlined in your letter, we cannot guarantee to do so. Sometimes it does take longer to fully investigate a complaint. However we do aim to find a soloution within 4 weeks. If we are not able to do so we will always write to you explaining what is happening. A full report or an update of our progress will be sent to you within 8 weeks. Should you wish to discuss the matter further, please do not hesitate to contact us on 0207 116 4561. Sincerely, Mike Brophy

Standard letter.

 

Load of rubbish.

 

My advice - take no notice, just stick to the step-by-step plan and to your timetable.

 

Seriously, I find this letter utterly contemptable! They do not need time to "fully investigate". There is NO investigation of your complaint going on. They already know what letter (again absolutely bog-standard letter quoted in many places throughout this forum) they're going to send you at the conclusion of their so-called "investigation". I hesitate to call them "liars", (the people who send out these letters are "just doing their jobs") but it's difficult to see this letter as anything other than an attempt to delay.
