We seem to be getting a few reports that RLP are passing cases on to JB Debt Collection of Glasgow which is a trading style of JB Ventures Limited

Consumer Credit licence No 0596203

 

If you get such a request,you should respond in writing by recorded delivery to JB Ventures Limited, Faith Avenue, Bridge of Weir, PS11 3SX

 

You should make it clear that you do not acknowledge any liability for monies demanded,that they are put to strict proof to furnish evidence that there are legitimate monies owed,and that they should be fully compliant with CSA codes of practice which they confirm on their website that they are subscribed to.

Also request a copy of their complaints procedure.

 

We are keen to monitor the levels of these business practices,so would ask that you keep threads updated and share info here.

 

Failing a response,or if demands then continue,you should be making an online complaint to the regulators,as well as your local Trading Standards office.(They will require copies of all correspondence)

Thanks for the information.

 

I have received a letter today from JB Debt demanding 187.50 pounds. I am surprised however I kind of figured what has happened.

 

Over about 6 months ago I was shopping in a retailer and trying to buy some clothes for my in-laws' kids since we were planning for a big visit instead of our Summer holiday. I had loads of kids clothes on my arms and I called my husband to reconfirm the ages of the kids that I was buying clothes for. The signal was really bad and I was talking and walking outside of the store, with the clothes. By the time I finished conversation, I was already outside of the door for 3, 4 minutes and I realised that I got all stuff in my hands without payment. I was sitting on the bench right outside of the door and thinking whether I should return those clothes. I made the wrong decision. While I was still sitting there the security guards came out and asked me whether I have paid the items. I guess the rest of the story you would imagine.

The policeman came as well. We went to the station together and I got interviewed (I will skip the horrible feeling I had back to then). A few days later another policeman contacted me and he told me that they decided to drop the case because it was not a serious crime and they trusted it was just a bad decision I made at hoc.

In the backroom of the store before the policeman involved, I was requested to fill a form and the security told me I would receive a letter from RLP soon. I didn't receive any letter for a while till I realise they probably got the old address from my drive license although I gave the correct address to the police. Silly me, called RLP and gave them my new address. However nothing happened! till today I just received the letter from JB. After reading through this forum I think what happened was:

RLP has sent me several letters to the old address however no response of course.

When they transferred the case to JB, the JB got my correct address. Hence in their letter it says:

 

"Our client (Ps, the retailer, not the RLP) have instructed us to collect payment for the above outstanding claim as you have ignored all previous correspondence...."

 

They asked me to respond within 7 days otherwise the client will consider legal action.

 

My question is, kindly could you please tell me, should I respond them? and to say "I didn't receive any claim from your client?" All I should pay since the policman was involved and I will lose the case if it goes to the court? In the letter, they also threatened that " A successful legal action could result in ...fees...plus interests. Such action could also affect your ability to obtain credit."

I expect it's the usual threats and don't think you should worry. You've said the police have decided that they're not taking this further? I think that would have been your main concern.

 

Our view is that there is no need for you to get involved with a parallel justice system where people like RLP and JB exist.

 

The forum guys will be along later, hopfully with further advice for you. I'm not sure in this case whether it is worth sending the standard letter after they've already sent a few, maybe one of the experts would confirm please?

The postcode is wrong - its PA11 - and its actually in Quarriers Village, near but apart from Bridge of Weir.

 

I'd been back in the UK on and off about ?30-36? months ago, and a DCA had sent letters to what I guess was everyone with my last name (which is forgein and not common). I cannot remember their name - but it may have been something like "Zinc" & I think they had no licence.

 

I obtained the addresses of the directors and popped round to see them. One was Castlemilk ?Ave/Drive? in the south of Glasgow (looked like empty council flat) and the one you list was the other. It was a new build white house with either an Audi in the drive or neighbour's drive. No one was in and the neighbour said it was empty (which it obviously wasn't) then that they were on holiday.

 

It might be fruitful if someone with an interest takes a look at their history here.

 

I am just occasionally lurking here now, as I moved out the UK again, and there is no internet access at the house I am building. However, having injured my knee carrying flooring up to the loft, I am having an easy life for a couple of weeks while it fixes, and there's access here.

Thanks a lot HB for your prompt response. Yes the police was very clear that they will not take this further and I was feeling released in deed back to then. I guess they believed what I said, that I didn't intend to do such thing from the beginning, and I had no crime history either.

My concern is, whether the retailer will listen to JB and take this further. If they do, I am afraid with policeman's involvement back to then it is hard to defend myself? However if pay, would it be the end?

Re Standard Letter, since I have never received any letter from RLP/JB for this case, would it be better to clarify that ?

The retailer wont do anything. It's pretty much all RLP trying to say you owe money when you dont owe anything at all.

 

THe police didnt do anything, and the retailer got everything back in sellable condition right? If so, RLP are trying to con you. Their previous methods of extorting money from people failed, so now theyre trying to claim for a non existant debt.

Thanks Renegadeimp. Somehow I feel much relaxed after reading your notes. Yes the retailer got all back and definitely was in sellable condition. Hopefully they won't change their mind and try to get back some "security" cost from the court...

The retailer wont do it, because the last time RLP went to court against a defendant that was properly prepared, they lost BIG time. The Judge had a right go at them and even said they had no basis for a claim. That doesnt seem to have stopped RLP harassing people though.

 

The retailer usually makes you sign a form that says you will never come to the store again and thats it. If the police wont prosecute, the retailer usually gives up and forgets about the whole affair, unless items were damaged. Remember, the retailer cant really make a claim. They have no real basis. Items were recovered in perfect condition and resaleable. No other costs incurred as security were doing the job they are paid to do. So what would they claim for?

RLP has sent me several letters to the old address however no response of course.

 

That could trip you up though. In any case, our suggested letter is in post #1 here, so if you want to write, I would send that. Don't give them any extra information.

 

I don't know if you will guarantee to stop any visit, but from what I've read they rarely turn up. These people seem to be a law unto themselves though, so it's hard to predict what they might do.

ALmost like a blizzard where i live, this morning. Pretty light now though. At least i got the day off work :)

Hello again,

I am about to send out the letter to JB however when I try to double confirm the address I am really confused. In their letter their address as head office is in Glasgow, in their website they said they are a part of the Zinc Group which is registered in Stratford Upon Avon, however in Post 1 here it is in Bridge of Weir as JB Ventures. Which add I should use please?

Many thanks for coming back to me. My understanding was, if this ends up in a court, it would look better if I responded to them for at least once? Also, if I want to warn them that they are not welcome to visit my property (don't want other family members know about it), a letter might be working? Or I am wrong, i.e. with or without a letter, it will be the same?
