i cant see why not.

 

i'd send a simple letter stating:

 

After reviewing information provided by the FOS and many other institutions relating to PPI reclaims,

there appears to be no specific referance toward creditors being allowed offset a PPI reclaim against an 'outstanding balance' on a debt,

if the debt does not contains 'notified arrears' then this appears to be allowed.

 

In this case, I can find no documentation from yourselves indicating this to be 'notified arrears'.

 

I am however, willing to allow the PPI reclaim to be used to clear any outstanding balance upon this condition:

 

THat the default marker & any other negative data is REMOVED from my CRA file.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I had challenged them previously againt set off and some of the confusion about the debt mentioned in another thread .

Recently , recieved reply from them . pdf attached

Hi ims21 ,dx100 and the cage family

Update as promised and good news is I have recieved thier ppi refund offer letter:whoo:,

amount is correct as mentioned over the phone when I called them for update .

 

I was also told by barclays that they are going to set off some of amount to my different laon a/c which still have debts after its own ppi refund set off .

We are talking about 2 diff accounts .

Their offer Letter states that refund will be credit to mr x and I don't have any a/c with bank any more,

also was not mentioned any set off in the letter just total amount of refund .

 

I need to reply to their offer and I need your help,

1) No mention of how refund amount will be credited

2) Even offer letter doesn't mention any set off, why was I told over the phone amount will be set off to different loan debts

3) If they want to set off then they have to remove Defaualt from my a/cs these debts would not have occured

if ppi was not sold wrongly .

Your pionters will help to draft my reply keeping in view those above pionts

they cannot offset if they have NOT sent a letter en titled

 

notice of sums in arrears [NOSIN]

 

it is wrong for that guy to say they will not look at or respond again

 

can i just check something..

 

these debts are still owned by barclays

Sorry have been away for some time

update

I have received refund cheque

 

meanwhile written to barclays' payment accepted as partly settled.

 

I also asked to remove that defaults entered against my credit file due to wrongly sold ppi .

 

no reply so far
