Before I begin forgive me if I dont explain properly but Ill try.

 

I had a wages arrestment before with Universal credit and Nolan solicitors of Kirkintilloch enforced it. I then moved jobs and obviously it stopped.

 

In between moving jobs etc I split up with my partner and moved house on the 1st Oct 11.

 

My ex passed on some letters to me in the middle of Dec. One of the letters stated that On the 15th Dec 11 an arrestment was sent to my employer with a decree for a wages arrestment. It had my old address on it and was dated after I moved.

 

No papers were served by a sherrif officer to myself at all and Im not just saying that in all honesty.

 

I have many questions but cant find any answers.

 

1. Can they do this

2. Do they need all details to be correct

3. Does a sherrif need to physically serve me papers

4. Is the arrestment enforcable

5. What can I do as the amount is over £40 per week and seeing as I pay csa etc I am totally broke and what can I do next as Im at the end right now.

 

I feel totally desperate and alone

 

If anyone can help it will be greatly appreciated

Hi,

 

I take it you did not pay the total amount due under the Decree whilst with your employer before you moved jobs.

 

The amount of any arrestment would depend the amount of money that you earn and is set out in The Statutory Deductions Tables in Schedule 2 of the Debtors (Scotland) Act 1987.

With the introduction of the Bankruptcy and Diligence etc. (Scotland) Act 2007 it is compulsory for the employer to tell the sheriff officers if the employee leaves their employment and the name and address of the new employer if known.
