Wrong Time On Speeding Ticket. Advice?

Hey all,

 

Have a friend who got caught speeding on motorway from camera van on top of a bridge.

 

The time is wrong because he wasnt in the area at that time.

 

Is there any come back from it?

 

Obviously speeding is speeding but given the error is there any chance of dodging it?

Are you saying that he has actually received a Notice of Intended Prosecution (with a requirement that he name the driver) that refers to a time that he was not at the location in question?

 

If the difference is significant - rather than simply a matter of a few minutes and better still if he can prove where he was at that time (work records/train or air tickets etc etc) - then the thing to bear in mind is not to second guess the police request. In other words, simply answer the question asked. He should simply reply supplying the requested details of the person who was driving at the time shown on the NIP/s.172 requirement - adding a section making it plain that the vehicle was not at the location in question or explain that the vehicle was parked at location x, and was not being driven at the time - whatever the truth of the situation is.

 

However, it is important that he ensures that he does not send in his reply until at least 14 days have elapsed after the alleged offence as this will prevent the police from discovering their mistake and issuing a revised NIP. As he is permitted 28 days within which to reply he would be better leaving matters until close to the end of that period.

 

If the police have messed up and quoted the wrong time then there is a good chance that no further action will be taken or if it is that it will fail.

Hi

 

Thanks for the response, however it turns out the idiot got the location wrong and was indeed in the area concerned at the time of the ticket, however says he cant remember seeing a van there. Well, obviously it was lol
