Hi all ive got 4 ppi claims going at the moment with RBS 3 are going ok but one claim is starting to cause problems as I have not been able to find the loan account number on the statements from my curent account that this loan was paid from it just says Royal Bank loan I have given them my account number and sort code and a copy of the original credit agreement showing ppi details and a reference number, but all they do is write back sending all my letters back to me saying the are unable to investigate with out an loan number the FOS say the bank have enough information from the details I have given to find there own account number, any one else ever had problems like this and if so how do I get to move this matter forward and is the RBS just been akward ?

Just confirms what I thought, sent them another letter stating how much it is costing in interest per day to them and asked them not so politely to pull there finger out :-)

This is yet another stalling tac.

Write to them and inform them that if they are not prepared to deal,then you will consider applying to the Court for an order for compliance,with costs.

I think you will find they will soon find the account number if they see you are not playing.

Well RBS have now accepted all the PPi complaints for investigation , however with some of the ones I started back in March , all I keep getting is letters asking to give them more time to investigate and some of letters are encouraging me to use the FOS , is this just another delaying tactic due to the heavy work load on the FOS ? and anything upto a 2year back log with them, may be time to take some action with them

Sounds to me like they are trying to get you to operate your claims on their timescales rather than yours. I'd be inclined to send a firm letter explaining the legnth of time they have had and give them a final 14 days before taking the matter to small claims court, but only if you are preapred to go that far.

Can you give us some idea what it comes to ?

First we need a little more info.......have you got specific grounds that can be set out in a POC ?

This is the one they have had since March loan taken out November 1999 : 36 ppi payments @ £28.97 per month APR 15.3% ive worked it out as follows : Principal and interest £1,230.29 plus 8% £295.54 total £1,525.83 untill the end of the loan from Nov 2002 (end of loan ) to date £2,545.17 am I close ???

Thanks for that I will start puting the presure on now :-)

Jist one point before I start sending the N1 over this one, the total I am claiming over four seperate claims is over £10.5 k will the court keep all the claims seperate ie below £5k or might this backfire on me ?

The net figure EXCLUDING interests needs to be at 5k or below.

Courts have discretion on this so if its say £5,150 then it may be ok.

The stat interest of 8% can be taken from the earliest charge.

Of course there is no reason why it has to be small claims,if there is a solid case then you have less worries about exposures to costs should it not go your way.

If you split them up into 2 claims,theres always a chance the other side may try to get them amalgamated to take them out of SCT-this is something we have seen before.

Could you not take the first one to SCC, win that one and then start another court action for No2 and so on. That way it would be difficult to have them amalgamated?

Not at all-in fact thats what some people do,its a case of weighing up the options.

In that scenario I would be minded to choose the one which is the most straightforward first.

It is of course not inconceivable that RBS may settle before any Court action,I would certainly be holding out more hope on these than I would if it was Lloyds.

well just clearing put some papers from Mums house and found another credit agreement of mine going back to 1998 insurance loan monthly payments £11.00 over 24 months better get cracking on with this one as well this will be number 5 :-)

quick update now had a reply from RBS saying that they have been given 16 weeks by the OFT to make an offer instead of the previous 8 weeks !!!!!!!!!!!!!!! as they have such a heavy workload imo if they had'nt misssold so many policys then they would not have such a heavy workload to sort them out ???? :-(

Yeah the FSA snuck that extension in without much publicity I'm afraid.

 

You could of course consider the court route rather than wait the 16 weeks?
