Again i find myself in the need of some advice.

 

Today i parked in what i consider to be a completly legal spot.

 

Perhaps im wrong.

 

As the picture shows im slightly on the corner of a very quiet street.

 

There are no lines at all and its out of a controlled zone.

 

I simply cant believe i have been issued a ticket for causing unnescessary obstruction.

 

Im not paying this, so advice on what to say on court and what will happen if i refuse to turn up would be great.

 

Im fed up of being conned out of my money.

 

Notice also the car in the background parked on the pavement with no ticket.

 

Theres no lines, no signs, nothing.

 

Im not parked over a dropped curb either.

 

Any help would be greatly appreciated,

You need to abide by the Highway Code. You haven't been conned.

 

Rule 243DO NOT stop or park

 

  • Opposite or within 10 metres (32 feet) of a junction, except in an authorised parking space

Whilst it is advisable to abide by the highway code, the majority of content within it is simply good advice and practice, not law. (btw you must be looking in an older highway code, because the 10mtr reference is under rule 217)

 

Where it refers to actual laws it uses the term MUST NOT and identifies the law reference below the item. Therefore, parking within 10mtrs of a junction is not illegal, just risky, and that is why the PCN is issued for "unnecessary obstruction" rather than the specific parking violation.

 

Nothing wrong with asking the council to clarify what the "unnecessary obstruction" was if, as the OP says, there is no dropped kerb or such like and it is a quite side street. If the council ticketed every vehicle parked near a street end in quite residencial areas then I think half the nation would wake up to a PCN every day when parking near their own house!
