I am thinking of claiming against Abbey for £170 of bank charges (for being overdrawn for 6 days) and I have read the advice that suggests opening a new account before you start in case your old one gets closed. I am thinking of closing the account anyway so that all of my direct debits can be transferred before I approach Abbey for a refund.

 

Have people found it more difficult to claim against a bank that they are no longer a customer of? Would I be better off claiming first, or does it really make no difference?

 

Any advice would be much appreciated as I'm new to this.

ALl the accounts im claiming against are closed, i dont think it makes any difference.

I am interested in this too. The HSBC account in question was closed by them & the outstanding balance sold to a collection agency.

 

We are currently in a dept plan with payplan, and as HSBC was our current account at the time we defected leaving our overdraft behind which is now in the plan and we are paying teh collection agency through payplan.

 

Would they pay us even though we did owe them money? all outstanding has been sold on. The account was closed by them 18 months ago.

The point is if they have applied charges to your account they owe you the money back, in effect they have unlawfully taken money from your account.

 

So i am not sure what payplans view will be, i used them but didnt know about these charges until i settled my debts.

 

But if the creditors owe you money then you should pursue it to redcue your debt. Even if you dont end up with cash in your hand you will potentially reduce the total you owe or the period over which you have to pay.

 

Im not sure if anyone else here has claimed while in a debt management plan i would do a search for payplan, cccs and also wait and see if anyone else turns up with information.

Ahha! The very same question as i was about to post.

Hi all, my first post and i wanted to know whether anyone had claimed money back from a closed bank account. I have just recently left my barclays account and closed it down. Ive had this account since i was a student and it has seen a fair amount of charges! Im about to fill out the initial form which will give me the total amount taken form me as i really have no idea!

Im already with another bank now so i suppose i cant threaten them with losing my custom anymore! Wish id found this site a few weeks back while it ws still open.

I'm with the CCCS or consumer credit councolor service and Citicard have sold their debt onto Cabosh finance. I'mgoing after the Citicard and as i understand it as they have sold the debt on then they will need to send me a cheque.

 

On the other hand, my other debtors....up to 15 of them will probably put the money straight into my account therefore reducing the debt I owe. having said that it has been said on this site that you can demand the money back in any form you like, i.e. cheque or credit to your debt account.

If you are in a debt management plan or iva i believe that if you recover money you are obliged to distribute it pro rata amongst your creditors.

 

So i think that it is right to insist that any creditors who may be sued are forced to send you the money for this purpose.

 

If you havent i would run the idea past your debt councillor or insolvency practitioner.

Hi glen that goes without saying really. It would be nice to have a cheque to spend but as I said the citicard account is closed so they can't refund the charges to my account / debt. Having said that and with a long way to go to pay off he debts every little helps. I don't know wether i would be happy with a pro rata to everyone because some of my creditors have been right twats and for me i'd rather give it to the ones who have helped me rather than those who have had me on the brink of suicide......
