Well had meeting, went in and gave her letter to read.

 

She started to read through it and then asked me a question about the lack of consultation stating that there had been a meeting about my redundancy. I answered 'do you mean at the grievance meeting'? She neither confirmed or denied this.

 

I then said that really if she wanted to just read through it and respond to me in writing that would be better and so the meeting ended there however she saw me touch a button my phone and thought I had been recording the short conversation because she said 'were you recording there'? I replied no and said it was incomfortable having a phone in jeans when sitting down. close one:smile:

 

Will provide update once I have recevied the content of her reply.

I have finally recieved my ex-employers final response regarding my appeal against redundancy.

 

As before she has answered none of the questions in the redundancy appeal letter about the lack of response to the grievances raised. In short she has said that the work for small firms will decrease with the advent of 'Alternative Business Structures' in October 2011. She has stated that she consulted me on the need to make me redundant in our grievance meeting of 4th May.

 

She has also written that she gave me responses to grievances raised despite not all of them being adressed. She does not accept that my redundancy is a smokescreen to conceal the genuine reason for dismissal.

 

She cannot let me do any meaningful work because of errors previously made which were made due to the stress I was under.

 

She has also stated that there is no other members of staff who could be considered for redundancy.

 

She then wishes me well for the future! very contradictory.

 

I was thinking that I should obtain a reference from her before submitting a ET1 to see what she says on it. Also, with regards to being consulted on redundancy in the meeting of 4th May this is untrue and she must have referred to her notes for this. What she does'nt know is that I recorded the meeting and there is clearly no mention of redundancy and the this was meant to be a grievance meeting anyway.

 

So, I am going to write for a reference first, but should I then highlight that she must have used her notes to specify redundancy in the grievance meeting and should I put her to test on this point by requesting the notes to prove as such?

Re. Appeal against Redundancy

Thank you for your letter of 1 July 2011 in which you detailed your reasons for rejecting my appeal against redundancy.

With regards to your statement about consulting me about redundancy in our grievance meeting of 4th May 2011, I do not recall this being discussed and as it seems you have used your notes that were intended to remind yourself of what was said and as I do not recall any part of the conversation where redundancy was discussed, I require you to provide the notes in full in order to confirm whether any conversation of this type took place at the grievance meeting.

Also, you have still failed to address my grievance in my letter of 5th April 2011 in writing regarding the victimisation and lack of confidentiality with regards to my personal information i.e. my grievance. You state that you have answered my grievance by handing your written responses at the meeting however you failed to answer the points in the letter of 5th April.

Lastly, can you please provide me with a reference for future use so that I may have a copy to hand when applying for jobs.

I look forward to hearing from you with regards to the above in due course.

blimey go out for an hour or 2 and suddenly activity occurs lol.

 

I have sent letter with SAR and would just like to confirm the time limit is three months and this counts from the last day of paid for work. i.e. got dismissed on 1 June, but paid as I did not need to work my notice until 1 July so does that mean the three months starts from 1 July???

I know, Rachel. The box used to tell you it was 90% full, now you just get an email notification if you signed up for it, telling you it's full. Or you can have me on your case :).

Your three months starts from the last date of occurrance, your last day of work OR the last day of your notice period. To the Mods - my apologies. Rules noted!

I think I will be representing myself at the tribunal. I have aquired a book called 'employment tribunal claims tactic and precedents' third edition by naomi cunningham and Michael Reed. Should be most useful in preparing.

Incidentally another question, can I bring other claims of victimisation which were never bought up at the time in a grievance but was a continuation of victimisation already sustained??

I have looked at the site and cannot find anything using their search tool. How did you access the previous precedents and cases?

Hi Marieleeza on the website you click on resources and then scroll down till its starts to detail databases and there are two avaiable. Here's a link to the one that I went on, its got a search engine and you type in the names that are on the precedents and it displays them.
