My bank owe me £3200. I have had no response to my first letter and so far none to my second. Are they not supposed to at least acknowledge receiving a letter at some point? Both of these letters were sent recorded mail. If I receive no communication from them what do I do? Do I just take it to court as I said or do I try to get a reponse from them first? Will it do me any damage if I have had no response from them? I feel that they would most likly say they have not had the letters. From what I have read it would seem that when it comes to this kind of money they do drag their heels. Has anyone managed to reclaim this much.

Well, if the letters were sent recorded delivery they would not be able to rely on the argument that they hadn't received them.

 

Not sure from your post whether your 2nd letter was the LBA (letter before action) but I would send that now if it wasn't.

 

Yes, people have reclaimed that amount of money and more in some cases!

Prelim Letter - Sent 27/03/06 ignored.

LBA sent 10/04/06 - Ignored

Moneyclaim filed - 26.04.06

Acknowledgement received 3rd May. Halifax state they intend to defend.

Halifax Settled in Full - 17 May 2006

Also mention in your letter that you will sue for an estimated amount and will inform the court that you had tried every means to get the correct amount but that they refused to comply with the DPA.

Also tell them that you will report them to the Information Commissioner.......

 

I am assuming you sent a DPA request and your £10 fee??.......
