Pioneer travel [problem] PLEASE HELP

Myself and my husband were in Benidorm between the 16th 23rd December.

On the 21st we were approached by someone in the town who asked us where we were staying and if we were enjoying it etc. She then said pick a ticket out of an envelope. The prize was a bottle of wine, she then said "Oh go on pick another" It was a Gold ticket which she got very excited about and jumped up and down saying we have either won a £1000 euros or a holiday for 4.

She scooped us up into a taxi and took us across town. We were welcomed by a women who said she wont keep us a minute and then took us into a room. we were sat at a desk with a women who gave us great quotes on reduced cost hols comared to what we normally pay.

Become a life member of Pioneer Trave club for £5995 you will make your money back in the first few years. There was a deposit of £1000. We did not have that money or afford the lifetime membership. She reduced it to 10 yrs at £3995 and £500 deposit. We stupidly agreed and paid the deposit on Debit card owing £3495 which they were going to get a Finance company to contact us to arrange paying them the £3495 then paying the finance £64 a month.

 

On our return to England we looked up the club to see lots of forums calling it a [problem].

It was Xmas so I did not check the back of the contract immediatly. When I did I found the cool off period was 7 days in writing. Well Xmas was here and it would not of got to Spain in time. We had missed the deadline. We e mailed the company and said we would not be paying the rest of the £3495 or go into any agreement with the finance company. We said we understand we forgo the deposit.

They have now said they will persue us for the £3495 through a UK debt collector and they always follow through agreements made that are after the cool off period.

WHAT DO I DO NEXT HELP

My advice would be to ignore their threats of debt collectors as they are unable to do anything unless Pioneer Travel firstly issue a county court claim against you which you either fail to defend or lose and then refuse to pay. Only at that stage can bailiffs be empowered to seize goods to the value of the debt. Debt collectors have no legal basis to seize goods before the court action I have described above.

 

There is a chance that PT could issue proceedings but IMO you have a possible counter-claim under the Unfair Contract Terms Act 2005. Since the whole premise of PT's business is allegedly one of false promises, this chance of court action may therefore only be a slim possibility.

we are in a similar situation as betsy 8 but paid £1000 the reainder to be paid on 22nd January 2011 We have received a default notice today and sought advice from others. The 7 day period should be at least 10 days maybe even 14 days. It does not state what these days are so assume that they are working days. This will help with cancellation date. It says on your paperwork that the contract is governed by Spanish law and Spanish courts and that anything verbal they will not be liable for so forget everything that George ever said. They have to get court orders before bailiffs are allowed to recover.Have you signed the finance agreement. I was not involved in finance so the default saying under section 87(i) of the Consumer Credit act 1974 does not apply but it also only applies in the UK and you traded in Spain

We missed a registered letter yesterday that is now back at the post office. I presume this would be the default notice you recieved. Shall we pick it up or just let it sit and rot at the post office? Was the letter from George?

 

Who did you get your advice from if you dont mind me asking?

Asa per thread above I recieved a registered letter of Default last week that I did not sign for so it was returned to the Post Office.

I know it was a letter of default as I now have recieved a letter from Marketing Systems Update S.I

This was the company that sold us the Pioneer Travel holiday Club which we now owe £3495 for.

The letter said as we have defaulted on the agreement they are passing our debt to Federal Managment LTD in the UK to persue our debt.

They have said that this debt collection agency will add both interest and charges to the debt so we should contact them immediatly to prevent this.

Can a debt collector add interest and charges?

I am continually anxious about this whole mess.

Asa per thread above I recieved a registered letter of Default last week that I did not sign for so it was returned to the Post Office.

I know it was a letter of default as I now have recieved a letter from Marketing Systems Update S.I

This was the company that sold us the Pioneer Travel holiday Club which we now owe £3495 for.
