      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I wouldn't for a minute suggest that there was any untoward behaviour. Just an old lady seeing many most complimentary statements and thinking how much many of you come across as being suited.

 

As I sit safe in my cell (not prison) enjoying the romance around too afraid to try it again for myself, pray allow me to romanticise: :eek: only to hand holding stage though: YEWK!

 

Ah chivalry! It is definitely still around but mostly in hiding rearing it's bonnie head, on occasion, to restore faith and cheer us on our way. :p:):wink:

Well, I’ve thoroughly enjoyed reading the exploits of all those fortunate enough to get to London on Friday. It’s as if I’ve had my nose pressed to the window, looking enviously at the merriment within. I think the contributions from VS and Bill-K reflect that feeling. We wish we had been there.

 

Congratulations to all of you who attended, on your resolve and commitment to the cause. It doesn’t matter if the numbers were perhaps less than some of you had hoped for. What’s important is that it happened, it was reported and the OFT know about it.

 

I now feel duty-bound to back up your protest by writing to the OFT. They need to know there are many more of us who are angry with their complacency. I don’t agree with the negative view expressed that it is all a waste of time. Let’s keep chipping away at the edifice.

Don't they realise that by trying to justify their actions in this way they are by implication admitting that their charges ARE a penalty or fine imposed by them without any authority or due proccess.

Yes, indeedy, Elsinore. I think the OFT effectively barricading themselves in, in the face of a small & peaceful demonstration effectively reinforced the point of the demo. And the apparently massive police presence showed that somebody was scared of you lot !! Well done, indeed.

Anybody help me find them. I notice Meagain & BW were comparing cameras earlier, so I'll look there, maybe.

In fact, it's total BS. In France, (can't speak for the rest of Europe), if you are o/drawn, it's because your bank let it happen. Therefore, they would be your accomplices in the fact, if it were true.

 

Technically, bouncing cheques is committing a criminal offence, but unless you go on a cheque writing rampage for 10's of thousands, the police will no more go after you there than they do here. It is in fact exactly the same here, if you are writing cheques without intention of having these met by the bank is committing fraud, and as much of an offence here than elsewhere.

 

Either way, the guy was talking poppycocks. (There's a surprise! :mad:)

Agreed BW It's obtaining goods or services by deception which I think is pretty much illegal everywhere............unless of course you happen to be a money lender

 

I think you got my point that the guy was claiming the right to punish the customer so admitting their charges ARE a penalty

 

Also very sorry to not be there looks like a good time was had by all if the photo's are anything to go by.

 

If BF can stand the bar bill again whens the next one?

Veering off a bit. Meagain earlier mentioned a problem playing the 5 News article. For those that want to watch the sterling performances of celebs Seminole & BF ad infinitum, the video clip is a ".wmv" file about 9MB in size, and is dumped in the temporary internet files folder.

 

If you copy it from there into your destination folder, you should be able to play it with your Windows Media Player. It's easier to find if you empty your TIF folder first, then load up and play the 5 news online link. The file you're looking for is "5W92BANKCHARGES.wmv"

 

And, yes - that IS how I get my free porn !! :cool:

The main reason I have trouble with Windows Media files is that I'm not running Windows. Something to do with Microsoft wanting to "protect" their media interests. ;)

 

There's probably a compatible filter kicking around somewhere. I can always lug it over to the Windows PCs at the radio station before doing my quiz show tonight.

Sorry, Meagain - wasn't sure what the problem was. This was a way of saving the file to HDD for when the online page eventually gets dropped. You might be able to play it with Nero "Showtime" if you have that. But you've probably got a better idea of what to do than I have.
