ticket was £40

 

was parking bay whereby your inly restricted from 9am to 10am

 

fee when they were at my door was £550 apprx

 

they claim they sold all FIVE items for £735

 

I have proof they sold ONE ITEM ALONE for £2800!

 

Other itmes were Samsung LE40A656 Crystak Design award winning LCD TV 40 inch that cost £1300 just a year before they took it!

 

A Panasonic BD-30 Blu Ray player that only come out the day I bought it around 6 months before

 

An antique Gold Omega Seamaster Automatic Watch that would cost around £600 to buy!!

 

In fact I will tell you a funny story. The bailiff said to me 'Omega? Yeah but thats a common make like Casio.' Uh-huh. On phoning the Auction house they asked if it was working his reply was 'Oh its really weird. It was not working when I picked it up and thoght it was broke, but while I have been walking up and down talking to you it has started working, bettery might be low'. Righhht

 

I said 'err mate its an Automatic! It works by wrist movement that actually winds it! No batteries in their mate and proves its real. Oh and I think you will find its worth a bit more than a Casio!' hehehe

 

You ARE the WEAKEST LINK! GOODBYE!

 

Whoever is the sting puller on all this I think they should seriously re-evaluate their partners in crime, lmao!

I am getting mixed up because JBW Group told me the bailiffs were responsible for the sale of the goods but the Invoice had JBW Group down on the invoice!

 

The council that employed jbw are responsible for the sale of the goods

its the council who Levy distress through there agents in this case jbw

a subject access request will give you chapter and verse of the bailiffs actions from the day 1 E.G dates times of visits charges connected with visits transcripts of phone calls copy of the notice of seizure auction info

so they don't necassarily have to be the ones names on the invoice/bill of sale, the council, but are IN FACT the ones responsible for the sale of goods?

 

hmm a friend of mine was on at me about going through the council on this,I wonder if thats the reason why?

I think you'll need to make it to the bailiff company as they will have the info you need. The bailiff works as the councils contractor hence council has ultimate responsibility...

well it WAS a £40 ticket this no dubt went up as i was contesting the bill to those concerned

 

I was in a bit of a sate as my uncle had passed away, i had lost both my father and my grandmother a few years earlier so in a bit of a state

 

but by the time they reached my door it was around £550. In fact my mate mentioned the amount today, he recalled it as £585

 

Once the incident calmed down the bailiff did say how ridiculous it was, I took this at him just trying to appease me so I didnt through him against a wall again, he waved a piece of paper at me and told me I was being charged £120 for the piece of paper. He went on to say that while in the van him and his mte said how ridiculous it was. But as he had knocked me onto my wooden stairs, within my home, and removed over £8000 worth of goods I was not going to listen to anything they said, especially the state I was in at the tiime.

 

I told them I had to sit down as I had hurt my back man-handling 'you two lumps'. I was quite shaken at the time. In all honesty I do not even go and wnswer my door to this day. My heart misses several beats when theres a knock at the door. I fear for what may happen if I do get a visit from someone else. But in all honesty theres nothing to take. I have had no TV since it happened and wrapped myself up in reading lol, god how blody sad that sounds!

 

My Orchids, Japanese Maples, renewed interest in Martial Arts (self control more than anything), Astronomy, cycling (I do have a beaten up rusty old bike still lol) and the Internet all keep me occupied.

It must be remembered that a bailiff enforcing a debt for council tax, National Non Domestic Rates (NNDR) or an unpaid parking ticketlink3.giflink3.gif is working as a agent/contractor for the local authority.

 

In this, the local authority cannot simply abdicate responsibility for the actions of their agent/contractor as ultimately, it is the responsibility of the local authority to ensure that a levy is carried out in a lawful manner and that the fees charged by their agents are in accordance with statutory regulations.

 

Following a discussion with the Local Government Ombudsmanlink3.giflink3.gif's Office (LGO) they have advised that if you have a Compliant for the Council about their bailiff's then you MUST do the following:

You must ENSURE that you mark your letter to the local authority as a : FORMAL COMPLAINT.

 

Your letter should be addressed to the CHIEF EXECUTIVE and should be COPIED to the COMPLAINTS DEPARTMENT ( this will ensure that it is registered as a formal complaint).

 

It must be understood that under the 1974 Local Government Act the Local Government Ombudsmanlink3.giflink3.gif only has jurisdication to investigate a complaint if the matter had first been brought to the attention of the local authority and that they had been given the opportunity to respond.

 

If you are unsatisfied with your response from the local authority then you can take your complaint to the Local Government Ombudsmanlink3.giflink3.gif but they will want to see that you have gone through the councils COMPLAINTS PROCEDURE first and that you have allowed the local authority a maximum period of 12 weeks to respond.

 

The Local Government Ombudsman's office will need to satisy themselves that you have made it CLEAR to the Local Authority that you are making a FORMAL COMPLAINT.

i have no way of contacting the bailiff, only the debt company

Its JBW you send the subject access request to you pay a fee of £10 then you give them 40 days to comply if they don't you can take them to court to get a judge to order them to release the info

i know soo much about soo many subjects but this was never an area i wanted to get into nor felt I would ever need to

 

when it comes to animals (reptiles amphibians and fish mainly), computers, astronomy, martial arts, cooking even, the paranormal, ancient history, meteorology/global warming, cycling I can gab til the cows come home. Even used to have groups of people would stay round to the early hours listening and asking questions. When it comes to this I know very little but am willing to learn just to prove MY point to a point when SOMEONE else takes up the gauntlet for me lol. Like Media and a Solicitor.

good luck allnights. those bailiffs and the council deserve everything they have coming to them. I hope you can see this through to the bitter end so they all pay to the fullest extent possible under criminal and civil law. essentially they are ****, no other word for it!

Clearly, allnights, you know an awfull lot about bailiffs then!

Let's see ... reptiles (very scaly things bailiffs), cooking (they like to cook the figures), ancient history (where they belong), global warming (not helped by their hot air), paranormal (You need CAG exorcists to help get rid of them), Cows (well, they like to milk people for all they can get away with)

unless you can find a solicitor who specialise in bailiff law (very few and far between) you are just better off doing this off your own back. i did have a solicitor to start with but i ended up knowing more than them, they ask me now about bailiffs lol

i will keep sending letters to solicitors til I find one that talks sense!

 

did i mentiom that one linked to the CLA (Community Legal Advice) actually told me it was ok for bailiffs to knock me on my arse and it was classed as peaceful entry?!

 

I have even kept copies of those and all others that said stupid things lol

 

I said 'thats funny because it is the complete opposite to what the police said!!' then i told them where to go and that I would report them for misinforming the public lol
