I sent a CCA request, for a friend who has gotten into trouble with Lloyds. They put Wescot onto it so I did the CCA to Wescot. He is only on benefits and they intimidated him, on the telephone, to accept £15 monthly payments. I though it was time for him to win back some power via the CCA route. They have returned the one Pound Postal Order with the following letter.

Dear Mr Benefits man,

 

COPY AGREEMENT REQUEST.

 

We refer to your recent letter requesting a copy of the credit agreement for the above account, pursuant to the consumer credit act.

 

We are not the creditor for this account but instructed on behalf of the above client. In the circumstances, we are returning your postal order which was made payable to Wescot Credit Services as this needs to be made payable to Lloyds TSB PLC. You can either send your request direct to our client or resend it to us and we will then forward it to them.

 

In the meantime, you will need to make arrangements to pay the account. We shall place the account on hold for 14 days to enable you to agree a repayment arrangement, but if we do not hear from you, it will be returned to the collections team.

They are such idiots :rolleyes:

 

All you need to do is to wait until the 12+2 days are up, then send the "in dispute" letter in the usual way. The reasons why they can't or won't produce the agreement are their problem, not yours. Then you sit back and ignore everything they send until such time as they send an agreement and you stop all payments.

 

If you want you can also report them to the OFT for misstating the true legal position, contrary to the OFT guidelines.
