have now recieved - with respect to my action against HSBC and Nationwide the following:

 

A) List of application for stay to be lifted before Designated Civil Judge on 18th March 2010 at 1030 am with a time estimate of half a day with case XXXXXXX

 

B) The parties are to file and serve not less than 3 days before the hearing writeen sumbmissions setting out their position in respect of these actions, given the terms of the judgement of the Supreme Court in the OFT Bank Charges Litigation

 

C) The parties will, at the hearing, be asked to state wht steps each has taken to compromise the claim.

 

Any advise?

As above NW partly settled.

 

Further NW have not changed there charges like some other high street banks, so i can't say pay me the difference plus interest - and us that offer as the carrot in terms of © settling the issue.

 

As posted on here, best to see what comes out of the new POCs and apply for a stay or not as appropriatte.

 

The hearing for my HSBC and NW case are set on the same day/time.

As posted on your HSBC thread, I think you should probably apply to extend the stay due to the issue of charges still not being settled by the Supreme Court, and the questions that arose from the decision.

 

You should also take the opportunity to amend your claim and reduce it by the amount of the refund that you already received.

 

You could write to NW and HSBC and say that you are willing to enter into negotiations with them to try and find a resolution to your claims.

 

I noticed that you mentioned time for preparation of your case. As this is a small claim you should not be claiming this. If you have included it, it might be an idea to offer to exclude this from your claim.

 

It will hopefully show the court that you are trying to be reasonable.

A) I will write to HSBC and NW re negoation as advised removing costs etc

 

B) I will apply for a further hold pending any response/evolution of questions that arose after hearing

I have just read The Consumer Forums - The Bank Charges decision - where to now.

 

And am actually pretty happy to write that my case would fall squarely into Reg 5.

 

When the charges were being applied i was suffering from PTSD - have doctors proof to that effect - provided to the NW and HSBC - they ignored it and then went about the usual activities as described in the article.

 

I intend to continue my claim against the bank and will post my draft to the bank re negotiation and trying to settle out of court shortly.
