These firms are riding a coach and horses over Consumer Rights;

there is too much of it;

an utter disgrace...

I would also like to know how they keep data away from other undesirables such as an abusive ex partner. or relatives ex friends whom you wish to have no contact. ps 192 cs i notice at time of posting you are still online but not defending or answering any questions.

It is not just 192, it is also firms such as confused.com;

consumers go onto such sites to check for the best prices, after a few months and upon making an audit of ones CRA credit files, it is discovered that ones data is being processed by firms who have been passed said data by confused.com...

consumers cannot obtain a quote without clicking the 'agree' button.

 

Consumers are being mislead and their subject data is being sold without consent.

 

Who in their right mind, would give 192 et al their consent?

I also beleve ALL selling/sharing of our data should be banned and credit checking reffences taken into governent control. with strict recording of details and masive fines for any company flouting the law say £150.000 and 4 years in the jail for the person who procesed the data and keying/admin error not useable as a defence.

Hi Kurvaface,

To access ER data, Directors etc a user has to pay to do so. We perform detailed checks to make sure the people purchasing are not fraudulent including manual checks. Each search is logged and kept and our Terms and Conditions state that these logs may be made available to law enforcement agencies. So anyone who is using 192.com for criminal purposes is leaving a detailed audit trail. If they were to go to their local council office/library to view these records there wouldn’t be any sort of trail.

I am wanting to help you all on the forum understand where our data comes from and why we are able to display it but I fear that no matter how many assurances I give or detailed explanations I provide you are not willing to help me help you. We do not sell your data on to any parties in the way that has been discussed on this forum and we do not display any information that isn’t already available in the public domain. Our working relationship with the ICO ensures that we do all that we can to provide a service in an environment that is acceptable and helpful to the majority. I have asked people to contact me directly so that I can enter into more detailed conversations with them ‘off forum’ however if people do not wish to do this there is little more that I can offer that I haven't already discussed.

the question is as per the DPA did you get "prior written consent"

 

as in many other you assume CONSENT then offer OPT OUT that is NOT how the DPA works

 

so unless you have obtained "PRIOR WRITTEN CONSENT" you are breaking the DPA by selling/forwarding INFO on your database,

 

you should now go to the ICO put your hands up telling them you got it wrong

I do not give you permission to share my data paid or unpaid regardless if it is in the public domain. My home telephone number, my electoral role details, my occupation are private. If you want my information please write to me and I will give you a very quick answer. ......NO!

I have not given your company permission to bundle together snippets of my personal data that now in its current form on your website paints a pretty detailed picture of my private life to any crook that wants it.

 

Your reassurance that you can follow an audit trail after this information has been abused is totally unacceptable. I can't think of any reason why any right minded person, if they were informed of your company's activities, would accept that as a safeguard.

But, 192 has not been provided with the necessary consent of each and every 'individual' (data subject) concerned!

 

Furthermore, much of the information that is already available in the public domain is often inaccurate e.g. data held and processed by Equifax, Experian and CallCredit!

My CAG motto translated into english goes something along the lines of "If you can't say it in public or put it in writing then you have something to hide"

 

Your wish to discuss "Off forum" could be interpreted by some as being insincere.

AC they are trying the same as the other crowd that did it a few months back with mobile phones

 

bottom line "NO PRIOR WRITTEN CONSENT" THEY CANNOT give any one info they hold regardless of what they claim to have in place

 

when they first started the [problem] a few years back I served a NOTICE on them , and not seen any of my data on their since,

 

once they are informed that permission is "NOT GRANTED" they have 28 days ( not working days ) to remove it , full stop

I feel that in view of the current massive ID theft problem the whole system also needs tightening up at the roots. It should emphatically NOT be a DEFAULT OPTION to have your data displayed in the full public register, and therefore accessible to these companies to misuse, sell on etc. We shouldn't have to tick a box to say no - that is open to mistakes. We should have to consciously tick to AGREE and give permission for our data being made public.

In the meantime, 192.com should take steps to remove any and all information on request, whether or not it is available anywhere else.

If we want our friends and relatives to find us, we'll CHOOSE to join Facebook, Friends Reunited or whatever.

I've no desire to have an entry in Debts Reunited or Credit Card Details Reunited, thanks very much.

We have been ex-directory since we got a BT line 18 months ago and have opted out of the electrol register for several or more years. At no time did we give 192.com permission to hold our details. Why should we have to complete a form to opt out when we never opted in? We will be contacting the commissoner's office direct without consulting 192.com as we never gave them permission. As for contacting the representative off forum, surely that is a joke as they will then have your email contact details in addition to the details that they already have which they shouldn't have! I wonder how much compensation we will get for the infringment on our privacy after 192.com has had a hefty fine?

2. Use of 192.com

 

The Service provides access to both free Information, which can be searched without the need to register and premium Information, for which you must register and purchase one of our credit packages. You can also purchase an extended archive membership enabling you to search archived Electoral Rolls. You may conduct a maximum of 10 free searches per day.

3. Credit packages

 

In order for you to search premium Information such as the current Electoral Roll; Births, Marriages and Deaths records; Census data; and Company and Director Reports you must choose one of our credit packages as offered from time to time. Your available credits will be reduced each time you conduct a search. Once you have used all of your credits you must purchase additional credits if you wish to continue searching premium Information. Credits should be used within six (6) months of being purchased at which point any unused Credits will expire.

 

VAT is non refundable on all international orders.

4. Restrictions on Use of the Service

 

You may use Information for reasonable personal use or, in the case of a business, for internal purposes only. You may not sell, rent, lease, publish or display Information to any third parties. You may not integrate the Service into another intranet/extranet other than by contracting with our 192 Business Services Division (Tel: 0207 909 2192), which offers multi-user intranet/extranet access to our services. You may not use automated scripts, software, spiders or any other automated means to perform searches on the Service. Any attempt to extract or download significant amounts of Information from the Service or to compile a database from Information obtained from the Service is strictly forbidden.

 

You are only entitled to use Information in fair, lawful and responsible ways and Information may not be used in any malicious, illegal or anti-social activity. We reserve the right to suspend any accounts where a user has supplied i-CD with a false email address or false personal data or where it comes to our attention that Information obtained from the service is being used in an inappropriate way.

 

You may not i) use Information to recreate, in whole or in part, any database, including the electoral roll or the directory enquiry database; or ii) use Information for direct marketing purposes; or iii) export or permit the export of any substantial amount of Information to a country which is not within the European Union; or iv) distribute any substantial amount of Information to third parties.

 

You agree that in relation to all Information derived from the Service you will comply with all applicable laws and codes of practice including the Data Protection Act 1998 and the Code of Practice on Telecommunications Directory Information Covering the Fair Processing of Personal Data (21 December 1998). You are warned that obtaining Information from the Service with the intention of using it for purposes other than allowed for in these terms & conditions may be an offence under Section 55 of the Data Protection Act 1998 and you should be prepared to justify your use of the Service to the relevant authorities.

 

You agree that if any complaint is made which relates to your use of Information you will assist i-CD and its data suppliers in investigating the complaint and You shall take such steps as are reasonably necessary to remedy the complaint as soon as possible.

5. Intellectual Property

 

The Information contained on the Service, the software used to operate it and the trade marks, logos and other intellectual property used in connection with it are the property of i-CD or have been licensed to i-CD. No licence of any such intellectual property rights is granted to you as a result of your use of the Service. Some of the telephone data provided on the Service is provided under license from British Telecommunications Plc. Through your use of the Service you shall have no rights in the BT trademarks nor any right to reproduce those trademarks on any material.

6. The Rights of i-CD

 

 

By using the Service you agree to these terms and conditions and you agree:

  1. to allow i-CD to Send you emails relating to your registration, purchases and account, including site upgrades;
  2. that if you select to receive the 192.com Newsletter we will email you the regular 192.com Newsletter;
  3. that if you select to receive 192.com Partner Offers we will also pass your information to very carefully selected partners of 192.com for specific and relevant promotions only (from which you can always opt-out). Email preferences can be changed from within the “Your Account” area of the Service.
  4. that i-CD may keep a log file of all searches, which can be made available to data subjects and/or the law enforcement authorities.
  5. to our Privacy Policy

Data subjects may request details of the information we hold on them, as laid out in the Data Protection Act. We will require proof of identity (such as a passport, utility bill or driver's licence). An administration charge of �10 will be applicable for such a request. Cheques should be made payable to: i-CD Publishing (UK) Ltd.

7. Protecting Your Security

 

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
