WS letterheads dating back to 1997 show the letters ASVA after S.N.Molloy's name, but I can't find what this abbreviation stands for, anyone have any ideas?

Wondering if its a foreign abbreviation used Ireland or USA

I can only guess it stand for something on the lines of Association of Valuers and Auctioneers

NAVA is the National Association of Valuers and Auctioneers, so the VA could be something like that.

 

Maybe Associate of some meaningless mickey mouse society?

I found the Incorporated Society of Valuers and Auctioneers which merged with RICS in 2000.

 

Family history | Royal Institution of Chartered Surveyors

 

Might be worth checking with RICS if Molloy is a member, or ever has been. If he is then I would think he'd be bound by there regulations.

For information I know Charles Smailes, as he was Chair of the NAEA Education Committee when I worked there in the Training Department, and I have nothing but the utmost respect for him.

 

If he thought any member of any organisation he is associated with was less than honourable, he would surely take action. He is a past president of the NAEA, which imposes high standards on its members.

He has no excuse to not get back to me, I email him directly aswell as recorded delivery letters for complaints.

I've been reading threads and reports about these LPA receivers selling to known contacts. Does anyone have anything to substantiate this?

Sorry Pigland,

 

Meant Steve Molloy as that he has no excuse as I email him and I am sure others might do aswell. He probably does get all of his letters but he cannot reply because he does not know what to do as hes making too much so planning for his next holidays instead. Whereas emails you know are getting to him because he replies one out of 50 emails.

Also, found out who Walker singleton apparently insure with it is Aviva if of interest to anybody, however sneaakily they have never claimed anything on this for me for example a boiler was stolen so they decided they were going to sell (In other words to much hassle for them to do anything about it) so I had it replaced to get it rented quick. Now since I have discovered about the insurance there have been times this should have kicked in when properties are vandalised especially when vacant. But they have never ever done this, cheeky swines.

 

The worst was when their contractors broke in the empty properties and left their stickers all over the house and left the front door wide open ready to be vandlised even more twice on two different properties, it was lucky because I regurlarly monitor them that I have come accross these . I flagged this up and they of course denied this and said at all time their contractors act with professional integrity but it was blatant ok maybe one off but twice this has happened. It is like they have tried several tactics to start the ball rolling to sell the properties with their excuse to the bank "the property is not worth spending loads of money because it has been vandalised so we recommend to sell immeadetely at whatever price you can get (Other words nothing!)."

 

I think its time to call the RICs and cause mayhem with every body group being made aware of these underhand tactics!

 

Also, I found my recorded slip for the SAR request sent in October last year with no reply, will write second stage for that now!

May I also suggest that you take photos of any properties and get them witnessed i by a friend who would be willing to attend court or any meeting(or a solicitor) with the LPA ?Then nobody can deny anything.

1.This is a very significant development in my view and hopefully the end of the securitised mortgages as we know them today.

 

2.Another seperate comment,if the LPA has put insurance cover on a flat that you own in a block and adding the amount to your mortgage account - there must be something fishy and not right because all leasehold flats are covered by the landlord's insurance.

 

3.However,this would not apply to masionettes as each dwelling has its own seperate entrance.

I dont have any flats in blocks with them, they are houses mainly. But my problem with them is they never use that insurance, for example what is the point if they dont exercise the vacant property insurance scheme especially when the property gets damaged and they sell because of this (and use this reason to justify to the banks), they should be fixing them up and then sell or rent, not depreaciate the value even more. this is basic common sense for me, now why can a Chartered surveyor cannot think this is beyond me otherwise lazy people!

Laziness does not come into the equation.

 

I have a similar problem and the fees exceed the rents and they have not been sending the rents to the mortgage company.

 

I am just waiting for the day when they sell my property and chase me for the shortfall.

 

I already warned the mortgage company of my actions but you see that they have no control as the mortgage has been securitised.

 

Anyway,LPAs DO NOT do the job that they are delegated to do so I think I will complain but not just yet.

Sorry if its a silly question, I am meaning to read the post about SPML. When you say they have no control, do you mean they cannot be sued for appointing a LPA reciever for making things worse or they cannot repossess?

Chillinlong,in reply to your last post and in my view:

 

1.Very briefly - as soon as your mortgage is securitised - the company that you have the mortgage with just collects the mortgages - in your particular cases it is HML that is just a centre that processes mortgages for more than one company.However,the control is with the invisible SPV who controls the fees levied on your mortgage and so forth.

 

2.Please remember that the securitised mortgage model is based on making a quick buck.How is this done?

 

a.Either by making the mortgage payer remortgage and pay very high fees.

 

b.Repossess and most interestingly(more like of great concern)due to the charges that were imposed by the SPV in the first place!Sell with possible shortfalls(through iffy esate agents,property investment clubs and LPAs mainly) that were made in an underhanded way and then on top of all this chase for the shortfall get a court judgement and if you have assets you have a charging order placed over more of your assets!

 

c.Personally,I think that you would have to sue the LPA with the lender and now that you know that there is a SPV who really owns your mortgage - it could potentially be a very complex case.

 

3.Probably the best and most cost effective route would be to sue for the rent losses plus the excessive fees and forget the SPV and with a bit of luck this could be the beginning of the end for securitised mortgages as we know and have had first hand experiences.

Also,the return of your property should be part of the final settlement and if it has already been sold damages equial to the value of your remaining equity had the property not been sold and assuming no illegal charges added on the balance of the mortgage.

 

Anyway,I hope this helps.

SPV sure does sound a long route but do able at some point. Was just thinking it would be ideal if we all could get involved with a class action as I have stated already on this post and appoint a top barrister to work out the ins and outs and move forward to get results for everybody.

 

Its time for me to decide what course of action I need to take this week as situation is not getting better since these guys Walker Singleton got involved and Mortgage express are aware of this.

1.I have no objection in getting involved in a class action and hiring a barrister as I have suffered both from a LPA and another securitised mortgage company.

 

2.In order to successfully do this,we will need to set out the common problems(which are already known to us) that we all have had/have regardless of mortgage provider - main residence or BTL as it makes no difference in my view.

 

Anyway,just my 2p's worth!

The more the merrier!

 

For starters,they could all potentially be sued for their fees whether due to being incorrectly charged,inflated or totally "made up".

 

This would apply to both all the lenders and LPAs too.

 

Also,please don't forget that this type of litigation would normally involve suing more than one lender and LPA too.Both lenders and LPAs have a very predictable ways of behaving especially after opening the lid on the securitisation issue.

 

So,in conclusion it might and hopefully would be less diificult than one would expect to put in action.

 

Anyway,again just my 2p's worth!

Love the article! I'm working on something at the moment that will spell it out to everyone, it encompasses securitisation and LPA receivers! It's pretty damaging! There's stuff I don't want to put up here yet because you never know who's watching and we don't want them to know everything!

 

I hope you get my drift!!!

 

Chillinglong can I suggest that when you write to the LPA for non-compliance of SAR you include;

 

Note; If a receiver has been appointed invalidly, because of a defect in his appointment or a defect in the security, he is a trespasser in law and both he and his appointor may be liable in damages.

I experienced exactly the same problem with WS re repairs covered by insurance. WS claimed that any damage I complained about was minimal and would cost less to put right than the £250 excess on the insurance.

What is the name of the contracters that WS are using to inspect your properties? Does it happen to be GMS Security?

Just telephoned RICS re complaints procedure against RICS members.

 

The first step is to complain to the firm concerned, however if the firm ignores your complaint you may complain to RICS regulation department direct on 0207 6951670.

Hi all,

 

Spoke to Steve Molloy today and he's told me they've just instructed a letting agent on the Property that he has been instructed on since June 09. After reading about what has happened to other properties he is appointed on, I went around to look at it! The door is smashed to pieces and someone has put a padlock across it!

 

If this is deliberate, these people are ****!
