yes it does affect your dla the dwp will ring dla even though they will try to deny it but they do you need to SAR the dwp and atos and ask specificly for the full audit trail this will include screen prinouts that if your lucky may show dwp and calls made to dla ?

I am bumping this thread, if for no other reason than to hopefully keep it in the limelight. It is a great concern to many people if this is beginning to happen.

It is happenening all over the place, and taking vital benefits away from those who actually need them.

 

Im just worried as at the moment my son has had to drop out of college due to his health, and it looks like he will have to claim ESA again. I would love to keep him myself but he needs his own money.

I did see this somewhere else but no idea where.

It is happening quite often and im sweating i dont lose mine as ive never had to go to an appeal on any Benefits. Claiming benefits has become a nightmare im sure its done to make us sweat and ill with worry?

Its been a long hard haul, but we have medical support from all his specialist and doctors. His support worker is fantastic as well, she sometimes takes him out for an afternoon to give me a break.

 

Its heartbreaking seeing your child suffer like he has, he has missed out on the last 5 years of his life through disablility and illness.

you could go to your local council and they may be able to help with regards to having a mentor in university my daughter has one who is available especially when she takes exams made a big difference to her she also got a grant from the council with regards to computors etc

We did try to organise something through the college, but due to him being hospitalised for almost 6 weeks last term and 3 weeks this term, they thought it would be best if he tried again next year.

 

He has another appointment wiht his phsyciatrist in 2 weeks to which I have been invited, and we shall organise som Occupational Therapy and counselling for him as he may be bi-polar too!!!

 

Its a nightmare to be honest, and I cant understand how someone who drives a desk can know exactly what every medical term means and the knock on effects certain drugs do to a person.

 

Sorry if Im ranting and going on and on about it, Im just so frustrated at the whole system.

you have my sympathies i know what you are going through,my daughter has come on leaps and bounds at uni since she had this mentor mostly for counciling but what a help our council have been cant thank them enough

WOW things are going ten to the dozen today.

 

Just had an email from MP as he has heard wind of our situation and wants to meet in with my son asap.

 

I suspect he was told on the quiet by a friend who works for the SNP!!!!!!!

 

Ive also spoken to his advisor at the JCP and she has reactivated his ESA claim as it was less than 6 months ago, and she couldnt believe the situation.

 

Maybe, just maybe things are finally turning a corner.

good luck to you but please dont hold your breath for too long what you need now is full reports ie doctors consultants and all the parifanailiay that goes with it..if you present your case in a simple manner the the DWP will back down but they will only go so far,,i was unfortunate that my EMP was a dinner geust of the head of the DWP only weeks before my complaint,,in other words i got nothing but waffle then dropped..i had to begin legal action through a really good BENIFITS ADVISOR they then backed down..so i spent over 6 wasted months of worry but i got it all backdated 3 years in my case even though they tried to backdate it 3 months...but their is case law of KERR V SECRETARY OF STATE it think but you are going in right direction..but try not to let it overtake your life good luck

Im in serious shock here :eek:

 

Ive just had a phone call from the First Minister, and although he cant help personally, he has passed our details onto our MSP and he would like to bring my son's case up in Holyrood in the next few weeks highlighting the mess that ATOS has caused some benefit claimants and the hardship and stress they have to go through to get the benefits they need.

thanks to Honeybee and Patrick for all the support, this past 2 days have been a rollercoaster of emotions for us all.

 

My son though now has the district nurse in 3 times a day changing bandages!!! So how can someone who drives a desk tell me he is fit to work and not disabled.

 

To look at his legs you would think someone has taken a potato pealer down them and removed the top layers of skin!!!

I read your story I hope you and your son get all the benefits he need, I just been refused dla first reason the form they've gone against everything i've put down secondly because i failed my ESA medical they've actually put the date of my esa medical which was last year well i was so happy to receive an accurate date for my esa medical becuase according to dla i was examined by their health professional and she was the one that made the decision that i was fit for work therefore i am not entitled to dla, well when i was at the medical i was not examined as the letter suggested there was no doctor available when i ask the woman where is the doctor i was told i would be examined she said what doctor there is only me and the woman who i saw just gave me her name she was no health professional also she told me that the dwp would be the one making the decision I believe they've put their foot in it with my medical their letter say one thing and the woman said another to top it all there wqsa no doctors available I would like them to tell me how they've made their decision without examine me nor have a doctor present as stated in their letter.

Update

 

We had the district nurse round today, and she says this is the worst case of eczema she has ever seen, and due to his mental problems too, she is going to push for OT and group therapy as well for him.

 

I also have my MP and MSP coming round on Monday afternoon to see him and see what they can do to help.

OK very very nervous now, only 3 hours til my guests get here, the house is spotless as usual, Ive baked enough homebaked to fill a small shop and now its off the the hospital with my son for a check-up!!!

Ok right the scoop on today :D

 

My MP couldnt manage but has requested all the paperwork from the Tribunal Service and is going to call me tomorrow or WEdnesday, he will also be asking DWP why it has taken them nearly 5 months to put it to appeal, rather than them doing it in the first place.

 

My MSP who did appear, is appalled! He is writing to Westminister to ask about the delay, and why there is so many inconsistancies in the reports and why has none of the medical evidence been looked at properly. He also wants to know why we have had no support at all from anyone apart from his specialist and dermatology nurses.

 

My welfare benefits officer says the more help we can get the better, and that DWP thinks that when someone is turned down they dont appeal due to them thinking they wont win, and he says they Didnt count on me fighting with nail and tooth!!! He is also going to contact the TS to get a nearer date as well, as Colin has deteriorated quite a lot in the last 6 months, and stress isnt helping.

 

So as soon as I hear more I shall post.
