Hi,

 

Ive read other people talking about different companies charging excessive fees wanted to know i am a business and i have a business account with a company called payzone well every time the direct debit was bounced they charged me £50 admin fee for late payment can i claim that?

 

What letter would be best, still the letter from the library regarding business accounts?

hi,

 

No payzone charges a EXTRA £50 each time their direct debit is returned as a extra admin fee!

 

Cant i ask them to show how a returned direct debit in my bank to them cost them £50 admin fee each time its returned, yet i dont even get a letter from them each a phone call to pay in straight away.

 

Can anyone advise me?

sorry my mistake your right it is a terminal base company but the bounced direct debits are for the sales minus my commision.

 

once the dd bounces they cut us off and charge £50 penalty fee for the bounced dd, so its like they taking my earned profit, if not more back off me!

 

Can i claim unfair terms of contract or something?

Thanks. That clarifies it as I couldn't work out why they were charging you!

 

Essentially if the charge is for breach of contract (which it clearly is), then it should be for no more than the cost that the breach causes to Payzone. The charge seems punitive to me and so I would say that you should be able to recover the charges in the same way as you could for a bank account or credit card.

 

One thing you need to consider is whether they will simply cancel your contract and the impact that this might have on your business.

thank you for that, one last question is that do i send the business letter from the library reffering to the common law again or do i send the normal letter?

 

Do you think my case is strong that the charge is punitive? Also do i have to inform OFT of this or not?

Business letter I would say.

 

I can't make any real judgement on the strength of your case, I'm afraid but if the charges are punitive you should be able to recover them.

 

You don't have to inform the OFT.

Dear

 

This is the first time, I'm writing to this forum. I've a dispute with Payzone.

 

I was dissolving a company to incorporate a new one, hence asked to change the direct debit and other details. After writing two letters, payzone, didn't respond and instead Warning charges messages started coming. They consistently avoid sending a written reply and instead starting giving calls with contradictory statements.

 

The caller threatened many times to remove the terminal but never did so and asked for end of contract by a fee of £250+ vat which I've been disputing. Can anyone help who governs payzone type of businesses in UK or whom to complain. I've written to OFT but they mentioned that it's individual business to business matter and legal help should be sort.

 

Like banks or telecom authorities, there should be a watch dog on these crooks as they can't be let loose to blackmail businesses. They also start referring to personal guarantee of individual behind a commericla contract. In this case, can an individual whom they trap as a guarantor not plea against their misleading terms & condition. They have written recently to take off the system but I'm sure they'll be coming up with another story to levy charges.

 

Urgent help would be highly appreciated.
